This <br /> period of retention is extended automatically during the course of any unresolved enforcement action regarding the <br /> regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Provide a copy of disposal records for the past three years, 5/22/22 through 5/22/25,for all <br /> hazardous waste including. Provide these records and a corrective action statement to the EHD within 30 days. <br /> This is (Class 2)Violation. <br /> 12 CA Code of Regulations 66262.40(c)3030053-Kept records of any test results,waste analyses, or other <br /> determinations. <br /> OBSERVATION:The sump/clarifier liquid waste is being disposed of as non-hazardous waste.The business operator <br /> did not provide records documenting the destination facility for the waste and that the analytical results for all samples <br /> taken 6/5/24 are within the facility's allowable limits. <br /> REGULATION GUIDANCE:A business operator shall keep records of any hazardous waste determinations made in <br /> accordance with Title 22 California Code of Regulations (CCR)section 66262.11 for at least three years from the date <br /> that the waste was last sent to an on-site or off-site treatment, storage,or disposal facility. The records may include <br /> Safety Data Sheets(SDS), waste test results or other hazardous waste determination documentation. <br /> CORRECTIVE ACTION: Provide EHD with records showing the destination facility for the waste and that the <br /> analytical results for all samples taken 6/5/24 are within the facility's allowable limits for the sump/clarifier liquid <br /> waste. Maintain copies on site with the analytical results. <br /> This is (Class 2)Violation. <br /> 21 CA Code of Regulations 66262.34(d)3030010-Disposed of hazardous waste within 180 days of accumulation start <br /> date. <br /> OBSERVATION: The following hazardous waste containers were found on-site with an accumulation start date of <br /> greater than 180 days or no accumulation start date: <br /> -The 55-gallon drum next to the train washer building was observed with a hazardous waste container, a small amount <br /> of liquid visible through the container, and no accumulation start date. <br /> REGULATION GUIDANCE: Title 22 California Code of Regulations section 66262.34. <br /> CORRECTIVE ACTION: Immediately dispose of the hazardous waste stored on site greater than 180 days in <br /> compliance with Title 22 California Code of Regulations.
