Provide a corrective action statement and supporting documentation to the San <br /> Joaquin County Environmental Health Department within 30 days. <br /> This is (Class 2)Violation. <br /> 38 CA Code of Regulations 66265.192(a)3010025-Obtained a written hazardous waste tank system assessment prior <br /> to placing into use. <br /> OBSERVATION: This facility has a 1,300 gallon hazardous waste tank of used oil and was not able to provide a <br /> hazardous waste tank assessment during the inspection. <br /> REGULATION GUIDANCE: Title 22 California Code of Regulations section 66270.11 Signatories to Permit <br /> Applications and Reports Title 22 California Code of Regulations section 66260.10 Definitions `Tank'means a <br /> stationary device, designed to contain an accumulation of hazardous waste which is constructed primarily of <br /> nonearthen materials(e.g.,wood, concrete, steel, plastic)which provide structural support. Title 22 California Code of <br /> Regulations section 66265.192 Design and Installation of New Tank Systems or Components. Title 22 California <br /> Code of Regulations section 66265.193 Containment and Detection of Releases <br /> CORRECTIVE ACTION: Have a qualified Professional Engineer prepare a tank assessment for each tank. Provide a <br /> corrective action statement and supporting documentation to the San Joaquin County Environmental Health <br /> Department(EHD)within 30 days. Provide a copy of all tank assessments,when available. <br /> This is (Class 1)Violation. <br /> 43 CA Code of Regulations 66265.195 3030029-Conducts/documents daily inspections of hazardous waste tank <br /> system. <br /> OBSERVATION: The facility has a hazardous waste tank but does not have three years of complete daily tank <br /> inspection records. <br /> -The facility has a 1,300 gallon hazardous waste tank of used oil.The facility could not provide daily tank inspection <br /> records for the past three years. <br /> REGULATION GUIDANCE: (a)The owner or operator shall inspect,where present, at least once each operating <br /> day: (1)overfill/spill control equipment(e.g.,waste-feed cutoff systems, bypass systems, and drainage systems)to <br /> ensure that it is in good working order; (2)the aboveground portions of the tank system, if any,to detect corrosion or <br /> releases of waste; (3)data gathered from monitoring equipment and leak-detection equipment, (e.g., pressure and <br /> temperature gauges, monitoring wells)to ensure that the tank system is being operated according to its design; (4) <br /> the construction materials and the area immediately surrounding the externally accessible portion of the tank system <br /> including secondary containment structures(e.g., dikes)to detect erosion or signs of releases of hazardous waste <br /> (e.g.,wet spots, dead vegetation); and (5)for uncovered tanks,the level of waste in the tank,to ensure compliance <br /> with section 66265.194(b)(3).
