• Hazardous materials incident from 2016 located on Guard Road 150 feet <br /> north of Highway 12, Emergency Response database. According to the <br /> listing, a five-gallon pail was abandoned at this location. Based on the <br /> nature of the incident, this event is considered unlikely to have impacted <br /> the subject Site. <br /> • 10500 Highway 12, adjacent to the south of the Site, Emergency <br /> Response database. According to the listing, approximately 7 gallons of <br /> non-PCB mineral oil spilled behind a shop in 2022. Based on the nature <br /> of the incident, this event is considered unlikely to have impacted the <br /> subject Site. <br /> • Hazardous materials incident from 2012 located at Peatland Road and <br /> Highway 12 (on or adjacent to northwest corner of Site), Emergency <br /> Response database. According to the listing, a big rig and a Chevy Blazer <br /> collided and caught fire, spilling "diesel, oil, and other vehicle fluids... into <br /> the irrigation ditch." Live Oak investigated this incident and determined <br /> that it involved a fatality and was widely covered by the news media. It <br /> appears that the irrigation ditch involved may be located at the northwest <br /> corner of the subject Site. Although further details of the hazardous <br /> materials cleanup could not be identified, it is likely that, due to the media <br /> coverage and involvement of local emergency agencies, the fluids spilled <br /> were cleaned up to the satisfaction of local authorities. <br /> Live Oak reviewed the San Joaquin County Environmental Health Department's <br /> maps of Nitrate - Land Use Data and DBCP - Land Use Data dated October <br /> 2021. The maps do not depict any wells tested for these constituents within a <br /> two-mile radius of the subject Site. <br /> 7.3 Agricultural Commissioner's Records <br /> Live Oak contacted the San Joaquin County Agricultural Commissioner's Office <br /> regarding agricultural use of the site. According to Monica Hernandez of that <br /> office, winegrapes have been cultivated on a portion of the Site by the Olagaray <br /> Brothers from 2020 through 2023, and rights-of-way have been maintained by <br /> the Reclamation District from 2020 through the present (correspondence, <br /> November 7, 2025). Numerous agricultural chemicals were applied to the <br /> property during that time, as indicated on the attached table (Appendix 5). No <br /> violations were identified. <br /> LOGE 2548 9 <br />
