The following used metal oil filter containers were on-site: - FIVE 5-gallon containers were found with crushed metal filters, the containers did not have a lid, no label, no accumulation start date. - ONE 55 gallon yellow container was found without a lid, no label, no accumulation start date. NOT: Facility was unable to provide documentation to establish how long the containers have been on site. REGULATION GUIDANCE: Title 22 California Code of Regulations section 66266.130 Management of Used Oil Filters. California Health & Safety Code section 25250.22 Fuel Filters CORRECTIVE ACTION: Immediately drain all metal oil and fuel filters of free-flowing liquid, store them in closed, rainproof containers. Label the container with the words "drained used oil filters" or"used gasoline filters", depending on the contents. Mark the container with an accumulation start date. Dispose of all used filters stored on-site greater than one year. Used filters not stored, handled and disposed of according to this section are regulated as hazardous waste. Provide a corrective action statement, disposal records and supporting documentation to the San Joaquin County Environmental Health Department(EHD)within 30 days. This is a Repeat(Class 2)Violation. 48 CA Code of Regulations 66262.16(b)(7)(B) 3010022 - Posted emergency information next to the telephone OBSERVATION: Modified contingency plan information was not posted at the facility. REGULATION GUIDANCE: The business operator must post the following information next to telephones or in areas directly involved in the generation and accumulation of hazardous waste: the name and emergency telephone number of the emergency coordinator, the location of fire extinguishers and spill control material, and the telephone number of the fire department unless the facility has a direct alarm. CORRECTIVE ACTION: Immediately post the modified contingency plan information or keep a copy of a complete consolidated emergency response/contingency plan on-site. Provide a statement to the San Joaquin County Environmental Health Department that the correction is complete. This is a Repeat(Class 2)Violation. 49 CA Code of Regulations 66262.16(b)(7)(A) 3030039 - Emergency coordinator on the premises or on call OBSERVATION: A complete modified contingency plan with an assigned emergency coordinator was not posted at the facility. -Accountant Linda Jimenez stated that there is not currently an assigned Emergency Coordinator. REGULATION GUIDANCE: The emergency coordinator or his designee must respond to any emergencies that arise.
