It seems
that the facility was on list at one point.According to the notes, only 8100 was stored at the facility, which
would exempt the facility from the state APSA regulations but not from the federal SPCC regulations. If the
biodiesel stored is B99 or below, because it has 1% (.1% per the SDS) or more of petroleum in it, that would
qualify the facility for the APSA regulations. Since the facility is in compliance with the SPCC regulations then it
most likely is in compliance with APSA, but that would put the facility on our list of APSA regulated sites and an
inspection would be conducted every three years to verify the SPCC plan and its implementation.
Based on the B99 capacity the facility is not exempt from the APSA regulations and inspections.
Cesar Ruvalcaba
San Joaquin County Environmental Health Department
Environmental Health Specialist
1868 East Hazelton Ave
Stockton, CA 95205
9 (209) 953-62131 L1 (209)464-0138 1 E cruvalcaba@slcehd.com
SAN JOAQUIN
C:JN I v
From: David Williamson <davidw@communityfuels.com>
Sent:Tuesday,June 19, 2018 7:08 AM
To: Cesar Ruvalcaba [EH] <cruvalcaba@sicehd.com>
Subject: RE: Corrected Label
1
