The Work Plan still did not propose vertical assessment; pumping test has not been competed; free product has not been removed. The EHD letter outlined specific tasks to be completed in the scope of work. 05/06/03- Site investigation continued with the installation of Geoprobe soil borings 05/23/03 and three additional groundwater monitoring wells during these dates. 05/30/03 Passive skimmer to remove free product was installed in MW-3 on this date. 03/04/04 Date of the EHD correspondence notifying the RP that they were out of compliance for failing to submit a Report of Findings that documents the fieldwork that was conducted in May 2003. The RP was given 14 days to submit the overdue report. 03/16/04 Date of Monitoring Well Installation Report by Ground Zero. 09/29/04 Meeting held at the request of the attorney for the RP, Gabbard Inc., to discuss site status. At issue is the continued presence of free product motor oil in well MW-3, and the distribution of PCE and TCE across the site. 10/26/04 Date of EHD correspondence summarizing the meeting and responding to the 3/16/04 Report. The EHD directed submittal of a work plan to continue the investigation. Deadline for work plan submittal was 12/17/04. 11/15/04 Date correspondence received by EHD from Ground Zero stating their position that further investigation of the site is not warranted. 11/23/04 Date of EHD correspondence to the Responsible Parties stating that further work is necessary and the deadline for the work plan to be submitted is firm. 01/10/05 Date of EHD correspondence; provided a14-day deadline to submit overdue work plan. 02/09/05 Date of Work Plan for Additional Site Work submitted by Ground Zero, 02/22/05 Date of EHD correspondence approving the Work Plan. It was, however, never implemented. 04/20/05 Active belt skimmer installed this date in MW-3 to remove free product. 04/19/06 Active belt skimmer shut down due to lack of free product removal. 05/04/06 Date of CUF letter stating Fund Manager Decision that no additional costs will be reimbursed. 05/08/06- Active belt skimmer was restarted and operated part time, during the day 05/12/06 only, to check for rebound of free product in MW-3. None was observed.
