A facility shall provide appropriate containment and/or diversionary structures <br /> or equipment to prevent a discharge. The entire containment system, including walls and floor, must be capable of <br /> containing oil and must be constructed so that any discharge from a primary containment system will not escape the <br /> containment system before cleanup occurs. Immediately provide adequate secondary containment for all aboveground <br /> petroleum storage containers larger than 55 gallons. <br /> 613 CFR 112.7(e) Failed to conduct inspections or maintain records for 3 years. <br /> Copies of inspection and testing records were not available for review at the time of inspection. Inspections and tests <br /> must be conducted in accordance with the written procedures developed in the Spill Prevention, Control, and <br /> Countermeasure (SPCC) Plan. Records of these inspections and tests must be signed by the appropriate supervisor or <br /> inspector and kept on site with the SPCC Plan for a period of three years. Immediately locate a copy of all inspection <br /> and testing records, maintain them on site, and submit copies to the EHD. This is a Class II violation. <br /> 614 CFR 112.7(f)(1) Failed to train personnel on discharge prevention._ <br /> It could not be determined if oil-handling personnel were trained in the contents of the facility's SPCC Plan. At a <br /> minimum, oil handling personnel shall be trained in the operation and maintenance of equipment to prevent discharges; <br /> discharge procedure protocols; applicable pollution control laws, rules, and regulations; general facility operations; and <br /> the contents of the Spill Prevention, Control, and Countermeasure Plan. Schedule and conduct discharge prevention <br /> briefings for your oil-handling personnel at least once a year to assure adequate understanding of the SPCC Plan for <br /> that facility. Such briefings must highlight and describe known discharges or failures, malfunctioning components, and <br /> any recently developed precautionary measures. Immediately provide this training to all oil handling personnel and <br /> submit a copy of the training log (included in the SPCC plan) to the EHD. This is a Class II violation. <br /> 702 CFR 112.8(b)(3), 112.8(b)(4) Failed to design facility drainage system from undiked areas to retain in the facility. <br /> The SPCC plan did not provide an adequate description of drainage associated with drainage to"bare soil" noted in <br /> Table 4-1: Potential Spills. Drainage systems from undiked areas with a potential for a discharge shall be designed to <br /> flow into ponds, lagoons, or catchment basins designed to retain oil or return it to the facility. If the drainage system is <br /> not designed this way, then the final discharge of all ditches in the facility shall be equipped with a diversion system that <br /> would retain oil at the facility. Immediately provide adequate description and design the facility's drainage systems to <br /> comply with this section and amend the Spill Prevention, Control, and Countermeasure Plan as necessary, or provide <br /> equivalence as allowed by CFR 112.7(a)(2).This is a Class II violation. <br /> 717 CFR 112.8(c)(8)(v) Failed to regularly test liquid level sensing devices to ensure proper operation. <br /> Procedures and frequency of testing for these devices were not addressed adequately in the Spill Prevention, Control, <br /> and Countermeasure (SPCC) plan. Liquid level sensing devices must be installed in accordance with CFR 112.8 and <br /> shall be regularly tested to ensure proper operation. Furthermore, the SPCC plan did not adequately address the tank <br /> integrity testing for the installed Convault Tanks.
