TRADE SECRET STATEMENT <br /> (Only complete this page if your business has trade secret information) <br /> Businesses are required to disclose hazardous materials involving trade secrets. Businesses must notify <br /> the administering agency in writing that the inventory sheets contain trade secret information. <br /> If your business has trade secrets, please sign below. This statement will be kept on file with your <br /> Hazardous Materials Management Plan. <br /> Trade Secrets may include,but are not limited to,any formula,plan,pattern,process, tool,mechanism, <br /> compound, procedure, production data,or compilation of information which is not patented, which is <br /> known only to certain individuals within a commercial concern who are using it to fabricate,produce, <br /> or compound an article of trade or a service having commercial value and which gives its user an <br /> opportunity to obtain a business advantage over competitors who do not know or use it. <br /> ADMINISTERING AGENCY IS REQUIRED TO PROTECT <br /> DISCLOSURE OF ANY TRADE SECRETS <br /> I. Upon receipt of a request for trade secret disclosure, the administering agency will notify the <br /> business in writing by certified mail with a return receipt. <br /> 2. The business will be given 30 days to file an action in an appropriate court of a declaratory <br /> judgment that the requested information is subject to protection as a trade secret. <br /> 3.
