10/16/95 15:�n LIST CLEANUP FUND -• 912094640138 Nn. 112 109 <br /> 5/24/94 USF EAR Account <br /> (2) request EAR Account funding; and, (3) present sufficient findings to <br /> support the requirement to obtain funding to take corrective action at a UST <br /> petroleum contaminated site to protect human health, safety and the <br /> environment. In addition, the resolution assures the State Water Board that <br /> the Regional Water Board and the LIA have fully considered the project(s) and <br /> that the Regional Water Board and the l.lA authority have been informed and have <br /> considered the urgency of the proposed project(s). <br /> Agencies requesting funds from the EAR Account shall provide the following <br /> site-specific information to the DCWP Chief: <br /> - Name and address of Regional Water Board or LIA requesting funds; <br /> - Name and address of all identified potentially responsible parties; <br /> - Location of the unauthorized release; <br /> - A description of the unauthorized release; <br /> - A description of the petroleum product(s) released; <br /> - A description of the water body affected or threatened and a description <br /> of the threat to water quality if any; <br /> - A description of the threat to human health, safety and/or the <br /> environment; <br /> - Documentation of why emergency response or prompt action is required if <br /> emergency or prompt action funds are being requested for a site; <br /> - A copy of any Cleanup and Abatement Order or other corrective action <br /> order issued by the Regional Water Board and/cr LIA; <br /> - A description of why the responsible party for the unauthorized release <br /> cannot or will not cleanup the contamination or abate its effects; <br /> Documentation of any disputes between the regulatory agency and the <br /> responsible party; <br /> - Any actions which have been previously taken to cleanup or abate the <br /> effects of the unauthorized release; <br /> - A description of how the proposed cleanup or abatement is to be <br /> accomplished; <br /> - An annual cast estimate and a total cost estimate for the proposed <br /> cleanup and abatement including staff costs; and <br /> - A description of the results if funding should be denied. <br /> CONTRACT REQUIREMENTS <br /> Section 25299.36 of Chapter 6.75 allows the Regional Water Boards to enter into <br /> oral contracts, if there is a situation which requires prompt action by the <br /> regional board to protect human health or the environment. The contracts, <br /> whether written or oral , may include provisions for equipment rental and, in <br /> addition, the furnishing of labor and materials necessary to accomplish the <br /> work. These contracts are exempt from approval by the Department of General <br /> Services pursuant to Section 25299.36 of Chapter 6.75, HSC. Oral contracts <br /> which exceed $10,ODC are subject to M/W/DVBE participation requirements. <br /> In many cases oral contracts are preferable because they enable the Regional <br /> Water Boards to move quickly in situations where prompt action is required to <br /> prevent substantial pollution, nuisance, or injury to waters of the State. In <br /> some of these cases, adherence to standard contracting procedures would hinder <br /> the ability of the Regional Water Boards to prevent harm to State waters. <br /> -9- <br />
