CFR 112.7(b) SPCC Plan failed to include a description of potential equipment failure <br /> direction, flow rate, quantity) or provide equivalence as allowed by CFR 112.7(a)(2) <br /> • SPCC Plan that included description of potential equipment failure was unavailable for review. <br /> • This Plan must indicate a reasonable potential for equipment failure (such as un/loading equipment, tank <br /> overflow, rupture, leakage or other equipment known to be a source of discharge), include in the Plan a <br /> prediction of the direction, flow rate, total oil quantity of oil which could be discharged from the facility as a <br /> result of each type of major equipment failure. <br /> • Correct by including in your Plan these description of potential equipment failure for all petroleum containing <br /> products and waste. <br /> #28. CFR 112.7(c) Failed to provide secondary containment and/or diversionary structures that <br /> are capable of containing discharge from primary containment until it is cleaned up <br /> • Four 55 gallon yellow drums of Solvent mineral spirits (three drums on top of wooden pallets above the dirt <br /> ground and one laying on its side on dispensing rack on concrete ground) and the form oil tank lack "specific <br /> sized' containment <br /> • Provide appropriate containment and/or diversionary structures or equipment to prevent a discharge as <br /> described in CFR 112.7(b). The entire containment system, including walls and floors, must be capable of <br /> containing oil and must be constructed so that any discharge from primary containment system, such as a <br /> tank, will not escape the containment system before cleanup occurs. <br /> • Correct by documenting the method, design, and capacity for secondary containment, you need only to <br /> address the typical failure mode, and the most likely quantity of oil that would be discharged for all petroleum <br /> containing products and waste. Immediately provide "specific sized" containment for the Solvent mineral <br /> spirits and the form oil tank sufficient to hold 100% volume of the largest tank or compartment plus adequate <br /> freeboard for precipitation. <br /> #29. CFR 112.7(d) Failed to provide explanation, conduct periodic integrity testing of containers <br /> and/ or periodic integrity and leak testing for valves and piping if containment or discharge <br /> prevention structures were determined to be impracticable on an SPCC Plan or sections of one <br /> that is PE certified <br /> • SPCC Plan that included explanation for periodic integrity testing of containers, periodic integrity and leak test <br /> for valves and piping was unavailable for review if prevention structures were determined impracticable by PE <br /> • Correct by determining if the installation of any structures or pieces of equipment to prevent a discharge from <br /> facility is not practicable, explain in the Plan why such measure are not practicable. For bulk storage <br /> containers, conduct periodic integrity testing of containers and periodic integrity testing of valves and piping <br /> #31. CFR 112.7(e) Failed to conduct inspections and test in accordance with written procedures <br /> and/or maintain signed records of inspections and tests as required by facility's SPCC plan on <br /> site for 3 years <br /> • Three years of records of inspections and test results were unavailable for review.
