from drilling and sampling of monitoring wells and the sealing <br /> of all wells drilled at completion of Kearney' s well-monitoring <br /> program, unless said sealing of said wells is waived in writing <br /> by Landowners . <br /> 3 . In the event that future development by <br /> Landowners of the property requires that any well installed and <br /> monitored by Kearney be relocated, Kearney agrees to seal and <br /> relocate such well in a manner and to a location that will not <br /> interrupt or interfere with the development of Landowners ' <br /> property. <br /> 4 . Kearney further agrees that Kearney shall destroy <br /> and seal any and all wells as herein provided, using procedures <br /> approved by any and all government agencies having jurisdiction <br /> over such monitoring wells and their closure after the required <br /> monitoring program has been completed. <br /> 5 . Kearney further agrees that at all times during <br /> the term of this agreement, Kearney shall keep and maintain the <br /> property of Landowners free and clear from any and all <br /> encumbrances or liens arising out of any work performed, <br /> material furnished to, or obligations incurred by Kearney, its <br /> agents, servants and employees . <br /> 6 . Kearney further agrees to repair any and all <br /> fences and gates damaged during Kearney' s operations on <br /> Landowners ' property, said repairs to be done to Landowners ' <br /> specifications . Kearney shall use only one ( 1) access route to <br /> the monitoring wells located upon Landowners ' property, said <br /> - 3 - <br />
