route being located to the satisfaction of Landowners . <br /> 7 . Kearney further agrees that to the extent that <br /> Landowners suffer any loss of use or pasturage of any portion <br /> of Landowners ' property, Kearney shall pay to Landowners the <br /> sum of Two Hundred and Fifty Dollars ($250 . 00) per acre or any <br /> portion thereof used by Kearney. For purposes of measuring <br /> acreage subject to this paragraph 7, any monitoring well dug <br /> shall be considered to be in the center of a one square acre <br /> portion of land. <br /> B . Kearney covenants that each groundwater <br /> monitoring well installed as in this agreement set forth shall <br /> be sampled quarterly until either three consecutive quarterly <br /> samples from said well each yield no detectable concentration <br /> of any volatile organic compound ( "VOC" ) associated with the <br /> Kearney-KPF facility, or until four consecutive quarterly <br /> samples from such well each yield concentrations for every <br /> "VOC" which are below the groundwater cleanup objectives that <br /> are established for the site in the site ' s RCRA Post-Closure <br /> Permit . Groundwater monitoring may be extended beyond the time <br /> provided for in this agreement by mutual agreement of <br /> Landowners and Kearney. <br /> 9 . Kearney agrees to lower the pump in any existing <br /> well located on Landowners ' property or replace the well with a <br /> well producing an equal quantity and quality of water as that <br /> historically produced by Landowners ' well or wells in the event <br /> - 4 - <br />
