that environmental remediation activities undertaken by Kearney <br /> on or in the vicinity of Landowners ' property cause Landowners ' <br /> well or wells to go dry or decrease substantially in usefulness . <br /> 10 . Kearney further agrees to pay Landowners ' <br /> attorneys fees incurred in negotiating and completing this <br /> agreement between Landowners and Kearney in the amount of <br /> $500 . 00 . <br /> 11 . Landowners and Kearney agree that any and all <br /> monitoring wells installed pursuant to the terms of this <br /> agreement shall be located on the property as said locations <br /> are set forth in Exhibit "A" attached hereto unless otherwise <br /> mutually agreed in writing between the parties, Landowners and <br /> Kearney. <br /> 12 . Kearney agrees tD save, indemnify and hold <br /> Landowners harmless from and against any and all claims , <br /> demands , suits for loss , injury, damage or liability of any <br /> kind whatsoever resulting from any negligence or intentional or <br /> unintentional actions in the activities conducted by Kearney, <br /> its employees, agents , subcontractors , representatives and <br /> assigns , in the installation, construction, operation or <br /> destruction of the monitoring wells herein descrioed. <br /> 13 . Kearney further agrees that Landowners shall not <br /> be liable for any loss or damage to personal property resulting <br /> from fire, explosion, fall or any other cause whatsoever in <br /> connection with the installation, construction, operation or <br /> destruction of the monitoring wells herein described, and <br /> 5 - <br />
