All facility communications or alarm systems, fire protection equipment, spill control equipment, and decontamination equipment, where required, shall be tested and maintained as necessary to assure its proper operation in time of emergency. Immediately begin this practice. This is a Class II violation. 403 CCR 66265.173 Failed to keep hazardous waste containers closed except when adding or removing hazardous waste. -Oily liquid was observed in the spill pallets under the product oil tanks and in the containment around the product oil tanks in the shop. All hazardous waste containers shall be closed at all times except when adding or removing waste. Immediately close these containers and ensure all hazardous waste containers are closed when not adding or removing waste. This is a Class II violation. 407 CCR 66261.7(f) Contaminated container not marked with date emptied or managed within one year of being emptied. Thirteen 55 gallon drums, a 30 gallon drum, and a 50 gallon fuel tank were observed empty in the shop area without being marked with the date emptied. Containers larger than five gallons that previously held a hazardous material shall be marked with the date they were emptied and managed within one year of being emptied. Immediately mark and manage all empty containers per this section. This is a Class II violation. 501 CCR 66265.192(a) Failed to comply with new hazardous waste tank system assessment requirements. Facility does not have a tank assessment for the 1,000 gallon used oil tank. The owner or operator of a hazardous waste tank shall obtain a written assessment reviewed and certified by an independent, qualified, professional engineer, registered in California attesting that the system has sufficient structural integrity, is acceptable for the transferring, storing, and treating of hazardous waste, and that the tanks and containment system are suitably designed. Immediately have an assessment prepared for the 1,000 gallon used oil tank. Submit a schedule showing when this will be accomplished to the EHD. This is a Class I violation. Page 8 of 11
