MEMORANDUM COPY <br />TO: Mr. Robert Haase, General Manger Polar Water Company <br />FROM: Pam Violett, San Joaquin County Environmental Health <br />DATE: March 17. 1994 <br />RE: Underground Storage Tanks (USTs) <br />Thank you for submitting the Monitoring and Response Plans for your facility on December 30, 1993. 1 <br />have just reviewed the documents today, and I apologize for the delay in getting back to you with my <br />comments. <br />The only Rem I see lacking from the Monitoring Procedure is #6 'The preventive maintenance schedule <br />for the monitoring equipment' [CA UST Regulations, Section 2632(e)(1)]. Basically, this consists of <br />determining what the manufacture of the Petrometer requires in terms of maintenance of the system. <br />Typically, maintenance involves an annual check of the monitoring system by a manufacture -trained <br />individual. The company that performs the maintenance should provide you with a document verifying <br />proper functioning of the Petrometer, probes, etc., and this document should be maintained in your <br />monitoring records available for inspection (you may also want to submit a copy of this document to my <br />office for your facility file). Please submit a revised copy of the Written Routine Monitoring Procedure that <br />includes this item by 4-18-94. <br />Another issue I wanted to make you aware of is the Financial Responsibility requirement for your USTs. <br />As of December 31, 1993, all petroleum UST owners or operators are required to demonstrate financial <br />availability for costs associated with corrective action and third party liability caused by an unauthorized <br />release of petroleum from an UST. There are several mechanisms that can be utilized to satisfy this <br />requirement including the California UST Cleanup Fund (USTCF). The USTCF provides up $990,000 per <br />occurance with a $10,000 deductible from the UST owner. The only two criteria that must be satisfied to <br />utilize this mechanism are: compliance with the CA UST Regulations (which your site currently is) and <br />proof of the availability of the deductible. I have enclosed information about Financial Responsibility, <br />including USTCF information, and the certification form that needs to be completed and submitted to this <br />office.
