MEMORANDUM COPY TO: Mr. Robert Haase, General Manger Polar Water Company FROM: Pam Violett, San Joaquin County Environmental Health DATE: March 17. 1994 RE: Underground Storage Tanks (USTs) Thank you for submitting the Monitoring and Response Plans for your facility on December 30, 1993. 1 have just reviewed the documents today, and I apologize for the delay in getting back to you with my comments. The only Rem I see lacking from the Monitoring Procedure is #6 'The preventive maintenance schedule for the monitoring equipment' [CA UST Regulations, Section 2632(e)(1)]. Basically, this consists of determining what the manufacture of the Petrometer requires in terms of maintenance of the system. Typically, maintenance involves an annual check of the monitoring system by a manufacture -trained individual. The company that performs the maintenance should provide you with a document verifying proper functioning of the Petrometer, probes, etc., and this document should be maintained in your monitoring records available for inspection (you may also want to submit a copy of this document to my office for your facility file). Please submit a revised copy of the Written Routine Monitoring Procedure that includes this item by 4-18-94. Another issue I wanted to make you aware of is the Financial Responsibility requirement for your USTs. As of December 31, 1993, all petroleum UST owners or operators are required to demonstrate financial availability for costs associated with corrective action and third party liability caused by an unauthorized release of petroleum from an UST. There are several mechanisms that can be utilized to satisfy this requirement including the California UST Cleanup Fund (USTCF). The USTCF provides up $990,000 per occurance with a $10,000 deductible from the UST owner. The only two criteria that must be satisfied to utilize this mechanism are: compliance with the CA UST Regulations (which your site currently is) and proof of the availability of the deductible. I have enclosed information about Financial Responsibility, including USTCF information, and the certification form that needs to be completed and submitted to this office. Please submit the Certification of Financial Responsibility to my office by 4-18-94.
