If an EPA number stillgxists for the site that may still be used if they want to bring in a
TTU to treat the waste, but if they closed the EPA number for the site, then they would
need to reapply for that as well.
3:00 p.m. David Irey and I met Mr. Hinkle and Mr. Smith at the site. Mr. Irey explained
to Mr. Smith that he could not speak to him directly because he is represented by an
attorney. Mr. Irey told Mr. Hinkle that he hoped Mr. Smith and the Tupas's would have
cleaned up the site more than they have at this point. Mr. Hinkle wanted to know if he
could sell the property once all of the waste is removed and Mr. Irey told him that an
assessment will have to be performed to determine whether or not contamination exists.
Mr. Hinkle asked if the stuff in the parking lot could be hauled away because it was not
contaminated. Mr. Irey told him to call his attorney about getting in touch with people
who could let him know whether the equipment was clean or not.
I told Mr. Smith that the equipment he asked me about this morning could be transported
to another facility for the same use but it must be considered safe, by him, prior to
transportation. I also told him that his tiered permit was not valid if the corporation was
dissolved. Mr. Smith said the corporation was not dissolved according to his attorney.
I told Mr. Smith that even if he still was a corporation, that to have his tiered permit valid
he had to renew it every year with DTSC. Mr. Smith said he would look into that.
3
