Photographs of the August 18, 1993 inspection are attached <br /> 1 <br /> (Attached as Attachment 5 and incorporated hereto by said <br /> 2 <br /> reference) . The list of violations noted during the inspection <br /> 3 <br /> includes, but is not limited to, the following: <br /> 4 <br /> 1. Sixteen 5-gallon buckets containing untreated hazardous <br /> 5 <br /> waste were unlabeled and open in the maintenance room in <br /> 6 <br /> violation of Section 66262 . 34 (f) (3) , Article 3 Chapter 12, <br /> 7 <br /> Title 22 California Code of Regulations (CCR) , and Section <br /> 8 <br /> 66265. 173 , Article 9, Chapter 15, Title 22 , CCR. Some of <br /> 9 , <br /> the buckets tested at pH 1 which is 10 times more acidic <br /> 10 <br /> than the regulatory definition for hazardous waste, thus, <br /> 11 <br /> in violation of Health and Safety Code Section 25189 . 5 (d) . <br /> 12 <br /> 2 . Ten 55-gallon drums containing hazardous waste were stored <br /> 13 <br /> past 90 days. The accumulation start dates were noted: 3- <br /> 14 <br /> 24-93 , 4-5-93 , 4-26-93 , 3-10 93 , 5-10-93 , 4-1-93 , 2-4-93 . <br /> 15 <br /> The storage of these drums is in violation of Section <br /> 16 <br /> 66262 . 43 (a) Article 3 , Chapter 12 , Title 22, CCR / Health <br /> 17 <br /> and Safety Code Section 25189 .5 (d) . <br /> 18 <br /> 3 . One 1-yard bin labeled as hazardous waste was not covered, <br /> 19 <br /> in violation of Section 66265. 173 , Article 9, Chapter 15, <br /> 20 <br /> Title 22 , CCR / Health and Safety Code Section 25189. 5 (d) . <br /> 21 <br /> 4 . One 1-yard bin labeled as hazardous waste was stored past <br /> 22 <br /> 90 days. This is a violation of Section 66262 . 43 (a) <br /> 23 <br /> Article 3 , Chapter 12 , Title 22 , CCR / Health and Safety <br /> 24 <br /> Code Section 25189.5 (d) . <br /> 25 <br /> 5 . Hazardous waste was stored in secondary containment sumps <br /> 26 <br /> which were not approved as containers. This is a violation <br /> 27 <br /> of Health and Safety Code Section 25189 . 5. <br /> 28 / <br /> 5 <br />
