MEMORANDUM <br />Date: April 16, 2001 <br />To: Ernest Giannecchini <br />Ernie's General Store <br />4407 E. Waterloo Road <br />Stockton CA 95205 <br />From: Letitia Briggs, Senior R.E.H.S. <br />Environmental Health Division (EHD) <br />Re; New Underground Storage Tanks (UST) Monitoring Compliance <br />On March 9, 2001, due to the SB989 requirement for annual UST system certification and <br />inspection, I performed a pre inspection review of the Ernie's General Store Underground <br />Storage Tank file. In the `old' file #1(1987-1998) I found soil sample results from the <br />January 5, 1999 tank removals. I reviewed the soil sample results, performed the leaching <br />potential analysis on the results, and found there had been a severe release of petroleum <br />hydrocarbons, mtbe, and oxygenates under the USTs invert and in the piping and dispenser <br />area. I filed a Prop 65 notice and UAR notice to meet state reporting requirements and the <br />unit clerk mailed a letter to inform Mr. Giannecchini, the responsible party, of the hazardous <br />motor vehicle fuel release. <br />During the same inspection file review, I documented items which were out of monitoring <br />system compliance in the new file #2(1999-2001): 1) No annual Monitoring System <br />certification, 2) No Monitoring Plan 3) No Response Plan, 4) No Financial Responsibility <br />certification and letter from chief financial officer submitted, 5) File lacked UST Installation <br />certification of compliance form C. The lack of these very important items revealed this site <br />is out of Monitoring System Compliance. On March 23, 2001, I filed State A and B forms <br />updating computer status of Ernie's to `Out of Compliance'. <br />Violations: <br />1. California Health and Safety Code (HSC) section 25284: Ernie's General Store has <br />not been issued an operating permit. Ernie's General Store has failed to submit <br />information requested on the February 18, 1999 inspection report by the March 4, <br />1999 compliance date. <br />2. HSC section 25292.2: Ernie's General Store has failed to submit Financial <br />Responsibility information requested on the February 18, 1999 inspection report by <br />the March 4, 1999 compliance date. <br />3. HSC section 25289(a)(b): Ernie's General Store failed to notify EHD to inspect <br />the dispensers located on the North East side after installation as Briggs requested on <br />
