California Code of Regulations (CCR), Title 23, Division 3, Chapter 16, section 2630 (d): Ernie's General Store has failed to meet the New UST monitoring system requirements by not conducting a monitoring equipment routine maintenance, service checks and monitoring equipment certification annually in 2000, or 2001. 5. California Code of Regulations (CCR), Title 23, Division 3, Chapter 16 section 2632 (d)(1)(A-G): Ernie's General Store has failed to submit a written monitoring procedure by the March 4, 1999 compliance date. 6. CCR section 2632(2)(A)(B): Ernie's General Store has failed to submit a written response plan procedure by the March 4, 1999 compliance date. 7. EHD has not received the Underground Storage Tank Installation Certification of Compliance Form C. Ernie's General Store was given tank certification and blue tags so the station could receive a fuel drop prior to conducting the precision test. The certificate and blue tags were issued with the understanding the items stated in the February 18, 1999 inspection report would be addressed by May 4, 1999. Because Ernie's General Stores newly installed UST's have never been in monitoring compliance, Briggs submitted new A &B state forms to update computer records showing the site is `out of compliance' as of March 23, 20001 To Achieve Permit Compliance the following items must be addressed: Financial responsibility must be submitted to EHD. 2. The monitoring system must be tested and certified operational. This test will include the northwest dispenser systems. 3. 4. A Written Monitoring Procedure addressing the requirements of CCR section 2632 (d)(1)(A-G) must be submitted to EHD. 4. A Written Response Plan addressing the requirements of CCR section 2632 (d)(2)(A&B) must be submitted to EHD. 5. Owner/Operator must contact contractor and complete the UST Installation Certificate of Compliance. 6. The monitoring system must have its' monitoring system tested and certified annually. Notify EHD of the date and time of testing.
