Then Fred Smith showed Jenni Frase the <br /> correspondence from CIWMB Michael Kith pointed out that Fred Smith did not fill out <br /> the facility TPID and phone number. That box was for the same address as hauler only. <br /> CTLs at Advanced Trailer were discussed. The CTLs in question documented tire <br /> transports that had been made in the Advanced Trailer vehicle that was registered as a <br /> hauler under Fleet/Brannon Tire. Jenni Frase explained that the receipt copy of the CTL <br /> should remain at Advanced Trailer and the yellow hauler copy should be kept at the <br /> Fleet/Brannon Tire location. Michael Kith borrowed the blank CTL form from Mr. <br /> Smith to demonstrate that the yellow copy was to be kept at the Fleet/Brannon Tire <br /> hauler site and the CTL customer receipt was to be kept at the Advanced Trailer site. The <br /> inspection report for Advanced Trailer also reflected this information. Jerold Brannon <br /> signed the inspection report and Jenni Frase gave Mr. Brannon the yellow copy. <br /> The third report delivered was for the inspection conducted on June 18, 2007 at the <br /> Fleet/Brannon site located at the Open Air Flea Market at 3550 N Wilson Way, citing <br /> two violations for existing conditions. Delivered along with the inspection report was <br /> CIWMB Notice of Violation (NOV) and copy of pertinent laws and regulations, and two <br /> attachments labeled A and B that were received from the facility on June 19 and June 20, <br /> 2007. Upon initial review, Mr. Brannon was visibly upset. Mr. Brannon shook the <br /> documents in his hand. Then Mr. Brannon set the documents on the desk and started <br /> looking at them one by one. Mr. Brannon stated, "This is harassment. I don't want you <br /> people on my property any more. Next time you want to come, you must get permission. <br /> You are making me ill. I don't want you here."Mr. Brannon dropped all the documents <br /> onto the desk and claimed that he (Mr. Brannon)would not sign the inspection reports <br /> until Charles Hastings, Mr. Brannon's lawyer,reviewed the documents. Mr. Brannon <br /> added that Mr. Brannon's lawyer advised Mr. Brannon not to sign anything without the <br /> lawyer's approval. Michael Kith informed Mr. Brannon, "We came here with your <br /> permission. Ms. Frase called you for that permission at noon. If you wish to revoke that <br /> permission you can; we will leave right now. Would you like us to leave now?" Mr. <br /> Brannon responded "No, what do you want from me?" Michael Kith explained, "All we <br /> want is for you to comply with the Laws." Mr. Brannon attempted to contact Mr. <br /> Hasting, Mr. Brannon's lawyer,by phone; Mr. Brannon could not reach Mr. Hasting. <br /> Michael Kith explained that refusing to sign the inspection reports was within Mr. <br /> Brannon's right and it would not change the outcome. Michael Kith then instructed Jenni <br /> Frase to write"owner refused to sign"on the Business Rep's Signature portion of the <br /> inspection report. Mr. Brannon continued to say things like, "A lot of other businesses are <br /> with me on this and we're gonna take this to court and we'll win in court," and"I have <br /> T.R.I.B. (Tire Retread Information Bureau) ready to help us change the law," and"My <br /> lawyer has beat things like this before, you know that? He's taking this case for free <br /> because he knows he can win,he has before" and"Have you even read the law? I have a <br /> copy of the law sent to me by the California Integrated Waste Management Board. <br /> Would you like to see?" <br />
