suspected that the illegally dumped tires came from this facility since the facility had <br /> violation for storing more than 500 waste tires without permit and now those tire <br /> disappeared and there was not documentation of what happened to those tires. <br /> At the suggestion of illegal waste tire disposal, Jerold Brannon asked Michael Kith if that <br /> was what Michael Kith thought Fleet/Brannon Tire was doing with tires. Mr. Brannon <br /> continued to say that Fleet/Brannon Tire spent hundreds of thousands of dollars for tire <br /> disposal every year and that manifests and invoices could prove it. Mr. Brannon asked <br /> Jenni Frase and Michael Kith something to the effect of, "Are you accusing me of <br /> illegally dumping my tires?"Michael Kith explained again that the CTL receipts are <br /> proof that tires are being handled properly. Michael Kith informed Mr. Brannon that the <br /> tires counted at the Flea Market on May 15, 2007 needed to be explained, "Where did <br /> they come from and where did they go?"Mr. Brannon again asked"What do we need to <br /> do? What do you want from me?" <br /> Jenni Frase then explained to Mr. Brannon and Fred Smith that at the time of the May 15, <br /> 2007 inspection, the Flea Market site was found to have over 500 tires which initiated a <br /> violation at that time. At the May 15, 2007 inspection and the June 18, 2007 re-inspection <br /> there were no manifests from the time period of January 2007 to May 2007 to explain <br /> how those tires had arrived there. At the exit interview of the June 18, 2007 re-inspection, <br /> the department had requested that the facility, Fleet/Brannon Tire, submit an affidavit to <br /> explain how the Flea Market site had come to have over 500 tires and to explain how the <br /> tires were being managed between the two sites. <br /> Jaime Alvarez then arrived and came into the office. <br /> Jenni Frase referred to the inspection report and Attachments A and B in front of Mr. <br /> Brannon. "These were the documents that you and your staff submitted to me after the re- <br /> inspection on June 18, 2007,"Jenni Frase explained. Attachment A was a worksheet in <br /> table form, submitted by Jaime Alvarez and Fred Smith by fax on June 19, 2007, that <br /> addressed seven trailers that were noted on the May 15, 2007 inspection report to contain <br /> used and waste tires. Attachment B was a letter signed by Jerold Brannon to "clarify the <br /> procedures that we at Brannon Tire used from January 2007 through May 2007."Jenni <br /> Frase addressed Attachment A first. The worksheet did not explain how the Flea Market <br /> site had come to have over 500 tires at the time of the May 15, 2007 inspection, which <br /> was the information sought, Jenni Frase explained. In addition to not providing the <br /> information , the document initiated another violation because it noted that CTLs had <br /> been falsified to satisfy the number of tires transported. Attachment B was then <br /> addressed by Jenni Frase. The letter signed by Jerold Brannon addressed, in a general <br /> manner, tire management between 3730 N. Wilson Way and 3550 N. Wilson Way, but <br /> the letter did not specifically explain how the Flea Market site had come to have over 500 <br /> tires at the time of the May 15, 2007 inspection. The documents did not satisfy the <br /> Department's request. <br /> During the discussion, the fourth inspection report was handed to Mr. Brannon. It cited <br /> manifesting violations regarding the adjacent site at the Flea market. Mr. Brannon asked <br /> Jenni Frase and Michael Kith what needed to be done to remedy the situation. Mr. <br />
