SANJ O 1` Q U I `IA,II, Environmental Health Department <br /> COUNTY <br /> Aboveground Petroleum Storage Act Inspection Report <br /> Facility Name: Facility Address: Date: <br /> MCLANE FOODSERVICE DISTRIBUTION 800 PESCADERO RD, TRACY January 09, 2019 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 612 CFR 112.7(c) Plan failed to include secondary containment, diversionary structures, or equip to prevent discharge. <br /> Secondary containment for the tanks in the"maintenance building"is not addressed in the plan.A circular metal <br /> cover with two holes in it was observed on the floor,within the concrete berm surrounding the two 15,000 gallon <br /> diesel tanks.The concrete berm acts as secondary containment for two 100 gallon used oil tanks and possibly for a <br /> larger used oil tank which is next to the two tanks but which is not mentioned in the SPCC plan. The two 15,000 <br /> gallon tanks are described in the SPCC plan as being double walled but appear to be single walled,which may <br /> make the concrete berm the secondary containment.The metal cover is labeled as"sewer"and is not addressed in <br /> the SPCC plan. It is unknown what is under the cover.A facility shall provide appropriate containment and/or <br /> diversionary structures or equipment to prevent a discharge. The entire containment system, including walls and <br /> floor, must be capable of containing oil and must be constructed so that any discharge from a primary containment <br /> system will not escape the containment system before cleanup occurs. Investigate what is under the cover and if <br /> necessary amed the SPCC plan to include a discussion of what is under the cover and if the the secondary <br /> containment would be compromised. <br /> This is a Class II violation. <br /> 618 CFR 112.7(e), 112.8(c)(6) Failed to keep records of procedures, inspections,or integrity tests for three years. <br /> Only the two 15,000 gallon tanks have documented inspections.Annual inspection forms provided in the SPCC plan <br /> are not being used for any of the tanks. Inspections and testing shall be conducted on all aboveground liquid <br /> petroleum containers equal to or larger than 55 gallons, including all 55 gallon drums of oil. Records of these <br /> inspections and tests shall be signed by the appropriate supervisor or inspector and kept on site with the Spill <br /> Prevention, Control, and Countermeasure(SPCC) Plan for a period of three years. Immediately begin necessary <br /> testing and inspections for all Aboveground Petroleum Storage Act regulated containers and maintain on site with <br /> the SPCC Plan. <br /> This is a Class II violation. <br /> 628 CFR 112.7(a)(1), 112.70) Failure to include in the Plan discussion of conformance with Federal and State <br /> requirements. <br /> The SPCC plan failed to include a discussion of conformance with the applicable requirements and other effective <br /> discharge prevention and containment procedures or any applicable more stringent State rules, regulations, and <br /> guidelines.The cross reference pointed to page 14 of the plan, but a discussion on the topic was not found.
