A teleconference summary is enclosed. We discussed the progress for providing a <br /> permanent water supply to Rocky's Restaurant as required by C&A No. 5-00-700, and the ability of the <br /> responsible parties to comply with a well destruction deadline of 31 December 2001 for Rocky's Restaurant <br /> domestic water supply well(RDW-1). As a result of the teleconference, we are concerned that the deadline to <br /> destroy RDW-1 will not be met. <br /> C&A No. 5-00-700, issued pursuant to California Water Code Sections 13267 and 13304, directs you to provide <br /> a permanent water supply for Rocky's Restaurant. A temporary bulk water supply was installed in March 2000 <br /> for drinking and food preparation uses; however, RDW-1 which was impacted with MtBE above the Primary and <br /> Secondary Maximum Contaminant Level, is still being used for cleaning, restrooms,and irrigation water. <br /> Orders No. 3 and 4 of C&A No. 5-00-700,require you to submit a plan by 10 March 2000 with a timeline to <br /> provide a permanent water source for Rocky's Restaurant. You submitted the plan to this office on <br /> 13 March 2000, and estimated that Rocky's Restaurant property would be annexed into the County Service Area <br /> (CSA) and connected to the CSA water system by 15 September 2000. We accepted your schedule. Although <br /> some progress has been made, Rocky's Restaurant is yet to be connected to a permanent water source. <br /> Therefore,you have violated your own schedule. Based on the updated time schedules to provide a permanent <br /> water supply presented in your Quarterly Monitoring Reports,Board staff agreed that they would not recommend <br /> enforcement as long as you were progressing to complete the required work in a reasonable amount of time. <br /> During a meeting with Mr. Bokides and his representatives on 5 June 2001,Board staff requested you to connect <br /> Rocky's Restaurant to a permanent water source and destroy RDW-1 by 31 December 2001. As presented in <br /> previous letters in thorough detail,RDW-1 has been determined to act as a conduit for contaminants to move into <br /> deeper water-bearing zones. Therefore,RDW-1 must be properly destroyed to protect groundwater resources. <br /> We reiterated this request to connect Rocky's Restaurant to a permanent water source and destroy RDW-1 in our <br /> 8 August 2001 Quarterly Monitoring Review letter. <br /> California Environmental Protection Agency <br /> 0%Recycled Paper <br />
