Mr. Trommer stated that the UST Cleanup Fund(Fund)received the 30 November 2001 Proposal <br /> for Abandonment of Rocky s Restaurant Drinking Water Well and Connection to San Joaquin <br /> County Service Area No.31 (Proposal) submitted by AGE on behalf of BFLP. However, due to <br /> the previous petition by BFLP for a Fund Managers Decision, a completed Proposal must now be <br /> submitted to the Fund Division Chief,Ms. Barbara Evoy. The scope of work outlined in the <br /> Proposal is estimated at $98,640.00, which exceeds the$40,000.00 approved for permanent water <br /> supply replacement costs by Ms. Evoy in her 21 September 2001 letter. Additional costs must be <br /> itemized and a completed checklist needs to be included in the application package. <br /> 2. We discussed BFLP's ability to comply with the requested well destruction deadline of <br /> 31 December 2001. Mr. Cuellar stated that once the pre-approval is received, they estimate it <br /> would take approximately three weeks to have the waterline connection plans approved through <br /> San Joaquin County Public Works and start the water connection work. Then, once the water <br /> connection is complete, RDW-1 can be disconnected and properly destroyed in about one week. <br /> Based on this discussion, BFLP will not be able to comply with our well destruction deadline of <br /> 31 December 2001. <br /> 3. In Ms. Evoy's 21 September 2001 pre-approval letter, she determined that the Fund would pay <br /> for bulk water through 31 December 2001. Therefore, Ms. Evoy must also approve any request <br /> for reimbursement to continue bulk water supply after 31 December 2001. Mr.Rishwain stated <br /> that they did not intend to use RDW-1 for human consumption or food preparation purposes at <br /> Rocky's Restaurant, and will rely on bulk water until a permanent water supply is secured. <br /> Board staff discussed the need to properly destroy RDW-1 to protect groundwater resources. Board and <br /> Fund staff also discussed that annexing Rocky's Restaurant Property into the County Service Area is <br /> increasing the property value, and that Mr. Bokides along with the two other owners of the Rocky's <br /> Restaurant Property should help to cover annexation costs. Finally, Mr. Bokides was advised that failure <br /> to comply with C&A No. 5-00-700 to supply a permanent water supply to Rocky's Restaurant may lead <br /> to civil liability(monetary fines) against all three responsible parties listed on C&A No. 5-00-700. A <br /> second teleconference was scheduled for 19 December 2001 at 10:00 AM. <br />
