Marley Cooling Tower Co. 3 <br /> (4) The owner or operator of an off-site facility shalL inspect and, if <br /> necessary, analyze each hazardous waste movement received at the facility <br /> to determine whether it matches the identity of the waste specified on the <br /> accompanying manifest or shipping paper. <br /> No detailed waste analysis plan has been prepared by Marley <br /> Cooling Tower Co. <br /> 5. Section 265. 13 (b) , Title 40, Code of Federal <br /> Regulations <br /> The owner or operator must keep the written waste analysis plan at the <br /> facility. <br /> Marley Cooling Tower Co. did not keep the waste analysis <br /> plan at the facility. <br /> 6. Section 265.52 (e) , Title 40, Code of Federal <br /> Regulations <br /> The contingency plan must include the Location and a physical description <br /> of each emergency equipment item Listed, and a brief outline of its <br /> capabilities. <br /> The contingency plan used by Marley Cooling Tower Co. did <br /> not have the location of the emergency equipment items <br /> listed. <br /> 7. Section 67104 (a) , Title 22, California Administrative <br /> Code <br /> (a) The owner or operator shall inspect his facility for malfunctions <br /> and deterioration, operator errors and discharges which may be causing, or <br /> may lead to, (1) release of hazardous waste constituents to the environment <br /> or (2) a threat to human health. The owner or operator shaLL conduct these <br /> inspections often enough to identify problems in time to correct them <br /> before they harm human health or the environment. <br /> Marley Cooling Tower did not have an inspection schedule for <br /> the facility. <br /> 8. Section 67104 (d) , Title 22, California Administrative <br /> Code <br /> (d) The owner or operator shall record inspections in an inspection log <br /> or summary. He shall keep these records for at least three years from the <br /> date of inspection. At a minimum, these records shaLL include the date and <br /> time of the inspection, the name of the inspector, notation of the <br /> observations made, and the date and nature of any repairs or other remedial <br /> actions. <br /> Marley Cooling Tower Co. does not keep an inspection <br /> schedule at the facility. <br />
