5. Lessee shall have the right at any time during Lessee's occupancy of the Leased <br /> Premises, and shall have the obligation u<�ithin ninety (90) days thereafter, to remove any and all <br /> bu'sldings, improvements, fixtures and equipment owned or placed by Lessee, its sublessee or <br /> licensees, in, under or upon the Leased Premises, or acquired by Lessee whether before or during <br /> the term hereof. <br /> 6. If the Leased Premises or any part thereof shall be taken for public purposes by <br /> condemnation as a result of any action or proceeding in eminent domain or shall be transferred in <br /> lieu of condc=ation to any authority entitled to exercise the power of eminent domain, the effect of <br /> the taking or transfer upon this Lease shall be as follows: <br /> (a) If only a part of the Leased Premises is taken or transferred in lieu of <br /> condemnation leaving the remainder of said Leased Premises in such location and in such <br /> form, shape and size so that, in the sole opinion of Lessee, it is still practical to conduct a <br /> service station thereon, the monthly.rental required to be paid by Lessee to Lessor shall, <br /> effective with the date of such taking; be adjusted by multiplying said monthly rental by a " <br /> fraction, the numerator of which is the area of the Leased Premises after such taking or <br /> transfer and the denominator of which is the area of the Leased Premises as described in <br /> Paragraph 1 hereof and said monthly rental shall be readjusted for each such taking or <br /> transfer of any portion of the Leased Premises;and <br /> (b) If only a part of the Leased Premises is taken or transferred in lieu of <br /> condemnation leaving the remainder of said Leased Premises in such location or in such <br /> form,shape or reduced size so that,in the sole opinion of.Lessee,it is impractical to conduct <br /> a service station thereon, Lessee may at any time thereafter terminate this Lease by giving <br /> Lessor ten(10)days'notice in writing of such termination;and <br /> (c) if the whole of the Leased Premises is taken or transferred in lieu of <br /> condemnation, Lessee may at any time thereaier terminate this Lease by giving Lessor ten <br /> (l0)days'notice in writing of such termination;and <br /> O•%Wor4p.,wYoun8ki20 Ckan,$.doc(6,s.#9.0557) <br /> g5�i1�94 <br /> J'.tI -t•;�';3 :.! !1 <br />
