its agents, consultants, . and contractors to comply -with all applicable federal, state, and local laws and regulations, including but not limited to those lawF and regulations applicable to the tests and remedial actions to be performed. Unocal shall be the owner and operatorof any equipment and wells it installs on' the Property, and Unocall shall be responsible for the removal or abandonment of said equipment and wells at- its sole cost and expense. Unocal shall a� its sole cost and expense properly store, transport -and da.spose offsite any contaminated soil, groundwater or' other material generated during the Work, and shall execute any hazardous waste manifest and other documentation with respect .to the storoge, transfer and disposal thereof. Prior to each portion of theWork for which such access is required, Unocal shall provide reasonable notice to Wells Fargo that such access is required, ana shall- provide Wells Fargo with a proposed schedule of the commencement and completion of each task to be- performed, and with a written work plan for the sole purpose of allowing Wells Fargo to understand the proposed scope of work to be undertaken during the proposed period of access and to review and-comment upon the location of the ,work and -any physical impact it may have on Wells Fargo-Is use of- the Property. Wells Fargo may request changes to the proposed schedule or the location of any work to the extent such work or testing will impair Wells Fargo's use of the Property In any way. Unocal will coordinate with Wells Fargo as to the location or ' type of testing or work to be done so as to take reasonable steps to minimize any impact on Wells Fargo' use of the Property by reason of the Work. 2 Data and Reports. Unocal shall provide Wells Fargo with copies of all scientific data and final scientific investigative reports obtained by Unocal with respect to the Contamination and the Work within two (2) days of receipt. 3 Repair. it any portion of the Property, including improvements and fixtures, or any portion of any property owned by a third party suffers damage by reason of the access -to the Property granted to Unocal, its agents; consultants, or contractors, including but not limited Ito damage arising from the Work or any related investigation and monitoring activities conducted upon the Property, Unocal, at its sole cost and expense, shall repair all such damages and shall restore the j Property and shall indemnify Wells Faro against any claims of damage to third-party-owned property resulting from Unocal's access to the Property.
