4 No Liability For Work. Neither Wells Fargo nor its
<br /> successors or assigns, nor its employees, agents, .contractors.,
<br /> subcontractors, officers, directors, shareholders, employees,
<br /> partners, .affiliates-, successors or assigns ("Personnel") shall
<br /> be liable for, and Unocal hereby waives any claim against Wells
<br /> Fargo or its Personnel for, any loss, damage or injury of .any
<br /> kind to any person or property caused by or arising from (a) any
<br /> access .to or use of the Property or any other real property by
<br /> Unocal or its agents, consultants or contractors in the
<br /> performance of Unocal's obligations hereunder, (b) any defect in
<br /> any building, structure or other impr8vement on the Property or
<br /> in any equipment or other facility therein. placed or used thereon
<br /> by Unocal or its agents, consultants or contractors, (-c) any — �'
<br /> negligent act or omission or. willful Misconduct by Unocal; or any
<br /> of its agents, consultants or contractors, or (d) any accident on
<br /> the Property or any fire or other casualty thereon caused by
<br /> Unocal or its agents,. consultants or contractors:" ' The provisions
<br /> of this Section 4 shall survive the termination of this
<br /> Agreement.
<br /> 5 Liens. Unocal shall not suffer or permit to be enforced
<br /> against the Property, or any part thereof, any mechanic's,
<br /> materialman's,' contractor's or subcontractor's liens arising 4
<br /> from, or any claim for damage growing out of the Work or any
<br /> other testing, investigation, repair, restoration, replacement,
<br /> or remediation work by Unocal under t is Agreement. Unocal -shall
<br /> pay or cause to be paid all such liens, claims or demands before
<br /> any action is brought to enforce them against the Property.
<br /> Unocal shall furnish evidence of payment upon any request of
<br /> Wells Fargo. Wells Fargo reserves the right at any time to post .
<br /> and maintain on the Property such notices as maybe necessary to
<br /> protect Wells Fargo against liability for all such liens and
<br /> claims. The provisions of this Section 5 shall survive the .
<br /> termination of this Agreement.
<br /> 6 Indemnification- Against Claims. Unocal agrees to indemnify,
<br /> defend, and -hold harmless Wells Fargo and its officers,
<br /> directors, shareholders, employees, p rtners, affiliates,
<br /> successors and assigns ("Indemnitees"}l including but not limited
<br /> to bona fide purchasers of, successors in ownership of, . holders
<br /> of •a leasehold interest in, and holders of a security interest in
<br /> the Property, from and against the following (individually, a
<br /> "Claim") : (a) any and all third party demands, claims and actions
<br /> for personal injury, death or damage to property against
<br /> Indemnitees, and from and against anyand all liabilities,
<br /> expenses, and costs which Indemnitees may sustain or incur,
<br /> arising out of and caused by the acce s to and use of the
<br /> Property by Unocal or its agents, consultants or contractors,
