STOCY J, CA 95205 FAX: (209 )1-6342 <br /> October 13, 1995 <br /> Mr. Doug Wilson, REHS <br /> Supervising Environmental Health Specialist <br /> San Joaquin County <br /> Environmental Health Division <br /> 304 East Weber Avenue, Third Floor <br /> Stockton, California 95201 <br /> Dear Mr. Wilson, <br /> In re: J & L Market, UST Removal and Installation Project, 8115 South <br /> E1Dorado Street, French Camp, California <br /> Elite IV, Contractors, Inc. (Elite IV) is currently scheduled to <br /> begin work on this project site November 1, 1995. All appropriate <br /> submittals have been made, fees paid and permits issued for this site. <br /> Elite IV is requesting that, as Supervisor of the tank unit, you review <br /> stipulations of the new tank installation as required by Jerry Yoshioka <br /> and Kasey Foley. They have required that a tank anchoring system be <br /> installed which they have indicated is based on a 90 year flood plain <br /> map. We feel this stipulation is unwarranted and not justified for <br /> numerous reasons. <br /> This anchoring system will cost our client approximately an <br /> additional six thousand dollars ($ 6,000.00) The requirements of <br /> replacing these tanks to meet current EPA deadlines is a severe <br /> hardship for our client who is a small independent operator. To meet <br /> regulatory requirements be met. This project is already costing our <br /> client in excess of three hundred thousand dollars ($ 300,000.00) . <br /> Further, according to the 1994 map (Enclosure one) showing lines <br /> of equal depth to groundwater. Fall 1994, J & L Market, indicated in <br /> pink, is shown to be located where groundwater is at approximately <br /> thirty-eight (38) feet. Also indicated on the enclosed map are two <br /> other service station sites. Indicated in blue as shown on page three <br /> (3) is a Chevron station currently under construction at Highway <br /> Interstate 5 and Lathrop Road. I have visited this site and spoken <br /> with construction personnel who have indicated they are NOT installing <br /> any anchoring system at that site. They have indicated that their <br /> permit does not require an anchoring system. I have further enclosed <br /> photographs which shows no anchoring system at that site. They have <br /> indicated that their permit does not require an anchoring system. I <br /> have further enclosed photographs which shows no anchoring system. <br /> This site is located where groundwater is indicated at a depth of less <br /> than twenty (20) feet. <br /> Further, another site in proximity to the J & L site and shown on <br /> the map in green is that of Mr. Jerry Moore of Moore Petroleum. <br /> Although construction has not yet begun, personnel have indicated that <br /> this site also will not be required to have a tank anchoring system. <br /> Further, our consultant, Mr. Ralph Morgan, a California Registered <br /> Professional Architect and California Registered Professional Engineer, <br /> has provided San Joaquin County Environmental Health Division with <br /> structural calculations indicating that an anchoring system and the <br /> resultant substantial cost to our client, is not necessary (Enclosure <br /> Two) . <br />
