On February 3, 2006, this office received a secondary containment test report for testing <br /> conducted on November 30, 2005, by Franzen-Hill Corp. Two of the under dispenser <br /> containment (UDC) sumps, 3/4 and 5/6, failed (Attachment 3). <br /> On March 21, 2006, Franzen-Hill Corp. made repairs to the system by tightening the entry boot <br /> clamps and retested the two previously failed UDCs. Both passed (Attachment 4). <br /> On June 8, 2006, Mr. Steven Shih, Lead Senior REHS, EHD, performed a routine inspection <br /> (Attachment 5) and witnessed the monitoring certification. A secondary containment test boot <br /> inside the 91 piping sump was found to be attached to the primary and secondary piping, <br /> preventing any potential releases from flowing into the sump and triggering an alarm. The alarm <br /> history printout indicated alarms in the annular (L1 sensor) and dispenser pan 5/6 (L8 sensor) on <br /> November 30, 2005. No documentation of these alarms was found addressing alarms. As of the <br /> date of this referral, a report for this monitoring certification has not been received by this office. <br /> On August 7, 2006, Ms. Lori Luces, REHS, EHD, sent a follow up letter to the facility <br /> requesting items noted on the June 8, 2006 inspection report (Attachment 6). As of the date of <br /> this referral, none of the items have been submitted. <br /> 610 S. Cherokee Lane, Lodi, Rancho San Miguel Market <br /> On February 28, 2005, Mr. Catanyag sent a reminder to Mr. Gilbert Silva of Food 4 Less by fax <br /> reminding him that six-month post construction secondary containment testing was due by <br /> March 2005 (Attachment 7). <br /> On January 20, 2006, Mr. Muniappa Naidu, Senior REHS, EHD, performed a routine UST <br /> inspection (Attachment 8) and Ms. Luces performed a hazardous waste inspection at this facility <br /> (Attachment 9). A current financial responsibility had not been submitted to this office and the <br /> designated operator monthly reports were not filled out completely. The annual monitoring <br /> certification, leak detector, and spill container tests were four months past due. Secondary <br /> containment testing was also noted as being ten months late. Used absorbent was being disposed <br /> of into the garbage and there was no contingency plan or emergency coordinator for this facility. <br /> A note in the inspection report stated that an EPA fD number application was provided this day. <br /> On February 3, 2006, Franzen-Hill Corp. submitted a secondary containment test report for <br /> testing conducted on November 30, 2005. UDC sumps 1/2 and 3/4 failed (Attachment 10). <br /> On February 21, 2006, Ms. Michelle Le, Senior REHS, EHD, witnessed the annual monitoring <br /> certification testing (Attachment 11). The 87 leak detector failed to detect a 3.0 gph leak at 10 <br /> psi. The operator was told to have this equipment replaced immediately under permit and <br /> inspection of this office (Attachment 12). A permit application was received by this office on <br /> February 23, 2006. Ms. Le witnessed the testing of the new leak detector on February 28, 2006 <br /> (Attachment 13). <br /> Page 2 of 20 <br />
