The draft CP calls for the removal of all hazardous <br /> waste, the tank, and all hazardous waste residue that might have <br /> escaped from the unit or associated piping into the adjacent or <br /> underlying soil. <br /> DHS will now proceed with having a notice published in a local <br /> Stockton newspaper, and a notice aired over a local radio <br /> station, requesting public comments on the draft CP. At the end <br /> of the 30-day comment period, DHS will decide if a Public Hearing <br /> is required to insure that the public has ample opportunity to <br /> participate in the Closure Plan approval process. <br /> DHS will consider all comments received during the public review <br /> period as part of the DHS final review of the draft CP. Because <br /> of these possible comments, DHS can in no way guarantee that the <br /> draft CP will be approved as submitted. The final CP will <br /> consist of the draft CP plus any revisions or additions necessary <br /> to address comments or concerns received during the Public Notice <br /> period. <br /> Upon completion of the closure activities described in the <br /> CP, the regulatory agencies will review the narrative <br /> certification report, to be submitted by a registered <br /> professional engineer and the owner or operator, that certifies <br /> that the unit was closed in accordance with the approved CP <br /> specifications. DHS will review ECC' s certification report and <br /> will then either accept or reject the closure effort. DHS <br /> approval of the closure certification will release ECC from <br /> further obligation to manage the waste storage tank as a <br /> hazardous waste unit per state and federal regulations. <br /> I have enclosed a copy of the radio and newspaper Public Notices, <br /> including a Statement of Facts describing the CP.
