Box 960001 <br /> Stockton, CA 95296-0320 <br /> RE: Tracy Defense Depot, Revised Draft Final Project Closeout Plan (Remedial Action <br /> Report) for SWMU 6, 20, and 27 Small Excavation Sites and SWMU 4 Wet Season <br /> Controls, September 2002 <br /> Dear Marshall, <br /> Thank you for the opportunity to review the Tracy Defense Depot "Revised Draft Final <br /> Project Closeout Plan (Remedial Action Report)for SWMU 6, 20, and 27 Small Excavation Sites <br /> and SWMU 4 Wet Season Controls,"dated September 2002. <br /> It appears that EPA's request to include an Institutional Control (IC) to maintain the <br /> asphalt cover was not included in the Revised Draft Final Remedial Action Report (RAR), and <br /> there is no response to comments to document the receipt of regulatory agency comments on the <br /> "Technical Memorandum; Solid Waste Management Unit(SWMU) 6 Supplemental <br /> Investigation"(SMWU 6 Technical Memorandum). The SWMU 6 Technical Memorandum was <br /> issued for regulatory review as a stand-alone document on August 7, 2002 and is now included in <br /> the Revised Draft Final RAR as Appendix J. Upon review of the SWMU 6 Techpical <br /> Memorandum, EPA noted in a letter dated August 15, 2002 that the remedy was relying on the <br /> asphalt cover to prevent the residual contamination from leaching to groundwater. There are no <br /> ICs in place to preserve this asphalt cover and no discussion of the issue in the Revised Draft <br /> Final RAR. Please include a recommendation in the Final version of the RAR for an IC to <br /> preserve the asphalt cover. Alternatively, describe what Comprehensive Environmental <br /> Response, Compensation, and Liability Act(CERCLA) decision document the Defense Logistics <br /> Agency (DLA) is considering for the documentation of this remedy modification, as originally <br /> requested by EPA in its August 15, 2002 letter. In addition, please include a response to <br />
