Spill Prevention, Control and Countermeasure Plan <br /> Tesla Treatment Facility Page 33 of 45 <br /> 2.13 Brittle Fracture Assessment [40 CFR§112.7(i)] <br /> 40 CFR§112.7(i) of the SPCC Rule is not applicable to the Tesla Treatment Facility. <br /> 2.14 Conformance with State Requirements [40 CFR§112.70)] <br /> Facilities subject to California's APSA are required to submit a facility storage statement to the <br /> local CUPA. This requirement is met by submitting the annual hazardous materials inventory <br /> information through the California Environmental Reporting System (CERS). APSA does not <br /> have any additional standards for spill containment and countermeasures not covered by the federal <br /> SPCC Rule. <br /> All storage tanks at the Tesla Treatment Facility are registered with the state and local authorities <br /> and have current certificates of registration and special use permits required by the local fire code. <br /> 2.15 Oil-Filled Operational Equipment [40 CFR§112.7(k)] <br /> Oil-filled operational equipment at the Tesla Treatment Facility that is subject to the SPCC Rule <br /> include the oil-filled engine crankcase in each of the standby power generators at the Emergency <br /> Power Generation Facility, and the oil-filled tank integral of the substation transformer at the <br /> Electrical Building. These oil-filled operational equipment meet the general secondary <br /> requirements in 40 CFR§112.2(c) of the SPCC Rule, and therefore, facility management has not <br /> relied on the alternate requirements provided in 40 CFR§112.7(k)(1). General secondary <br /> containment measures in use for the oil-filled operational equipment are discussed in Section 2.7 <br /> of this SPCC Plan. <br />
