c.Conflict with Williamson Act <br /> Potential Significant Impact(A.7): <br /> The proposed project expansion onto the Brocchini Parcel may conflict with the requirements of <br /> the Williamson Act Section 51.295. <br /> Finding: <br /> Based upon the analysis in the EIR,reenrollment of the Brocchini parcel in a Williamson Act or <br /> similar contract will make impacts from conflict with the Williamson Act less than significant. <br /> The following mitigation measure will mitigate these impacts to below a level of significance. <br /> Mitigation Measure (Impact A.7): <br /> As appropriate, and in consultation with the State Department of Conservation, <br /> I implement one of the following measures to assure Williamson Act consistency: <br /> 1) Reenroll the Brocchini parcel in a Williamson Act contract or encumber the parcel <br /> with an enforceable restriction with terms at least as restrictive as those provided by <br /> Government Code Section 51295, with a duration determined in accordance with the <br /> requirements of Section 51295; or <br /> 2) The County may make applicable findings to cancel the Williamson Act contract on <br /> the affected parcel; or <br /> 3 The State may reevaluate the situation and, if appropriate, determine that the parcel <br /> does not require renrollment because Section 51295 does not apply in this case;or, <br /> 4) The parcel would be reenrolled in the Williamson Act but the State may consider the <br /> proposed landfill use compatible with the Williamson Act, as permitted under County <br /> Williamson Act implementingpolicies. <br /> Provide written notice to the State Director of Conseryation and the local governing <br /> bodyonsible or the administration of the agricultural preserve in accordance with <br /> b y res p -f � <br /> the requirements of Section 51295. f <br /> J <br /> Facts in Support of the Finding: <br /> The potential for conflict with the requirements of the Williamson Act Section 51295 is discussed <br /> in Section IILA of the EIR. Reenrollment of the Brocchini parcel would comply with the intent <br /> of the Williamson Act for preservation of agricultural lands. <br /> P 15 <br />
