g.Accidental Take of Special Status Species
Potential Significant Impact(F.7):
Conversion of 213.9 acres of Agricultural Lands to other uses could result in incidental take of
special status species covered by the San Joaquin Multiple-Species Habitat Conservation and
Open Space Plan(SJMSCP).
Finding:
Based upon the analysis in the EIR,payment of the mitigation fee to fund acquisition of preserve
lands for covered species that could potentially be affected will make impacts on potentially
affected species less than significant.
The following mitigation measure will mitigate these impacts to below a level of significance.
Mitigation Measure (Impact F.7):
I
According to the SJMSCP, the mitigationfee for conversion of Agricultural Lands to
other uses is $1,500 per acre. For the conversion of 213.9 acres of Agricultural Lands,
the property owners, developers, or their successors at interest shall pay$320, 850, or
other fee as calculated by the SJMSCP Joint Powers Authority(JPA) to the JPA to fund
acquisition of preserve lands for covered species that could potentially be affected.
Facts in Support of the Finding.
The potential for impacts to special status species is discussed in Section IILF of the EIR. The
SJMSCP is designed to mitigate impacts on potentially affected species.
h. Impacts on Sacramento River Winter Chinook Salmon
Potential Significant Impart(F.8):
Construction activities in the North Branch of the South Fork of Little Johns Creek could result in
significant adverse impacts to Sacramento River winter chinook salmon.
Finding:
Based upon the analysis in the EIR,appropriate scheduling of work in Little Johns Creek
turbidity studies,and compliance with recommendations of the National Marine Fisheries Service .
Iver winter chinook salmon less than significant.
acts on Sacramento R
will make impacts
The following mitigation measures will mitigate these impacts to below a level of significance.
Mitigation Measures (Impact F.8):
(a) To avoid impacting Sacramento River winter Chinook salmon in Little Johns Creek,
all proposed work that would impact this creek should occur in the summer months when
this salmon would not be migrating/spawning in this creels If work must occur during
30
