f ATTACHMENT C STATEMENT OF OVERRIDING CONSIDERATIONS FOR THE AUSTIN ROAD LANDFILL EXPANSION A. SIGNIFICANT UNAVOIDABLE IMPACTS OF THE PROJECT: The Planning Commission of San Joaquin County has reviewed the Supplemental Environmental Impact Report(EIR)prepared for the permit approvals for the Austin Road Landfill Expansion, as proposed by the City of Stockton(the Project). The EIR has been prepared in accordance with the California Environmental Quality Act(CEQA), and consists of the Draft Supplemental EIR dated 12 November 1999, including the appendices thereto,and the Final Supplemental ETR dated January 31, 2000, containing the comments and responses to comments(the ETR). The Planning Commission has made findings related to the EIR prepared for the Project pursuant to Section 21081 of CEQA(hereinafter the CEQA Findings). Section 15093 of the CEQA Guidelines requires the lead agency to balance the benefits of a proposed project against its unavoidable significant,adverse impacts and to determine whether the project-related significant impacts can be acceptably overridden by the project benefits when the two are compared and balanced. As outlined in the separate CEQA Findings, Section IV.C. prepared for the Austin Road Landfill Expansion,the project as proposed would produce unavoidable,significant adverse impacts in four environmental categories:Land Use, Plans and Policies(project-related);Visual and Aesthetics(both project-related and cumulative);Air Quality(cumulative only); and Geology, Soils,and Seismicity(project-related). The Planning Commission adopts this Statement of Overriding Considerations with respect to the significant,unavoidable impacts identified in the EIR, especially identified as: 1.Land Use,Plans and Policies a.Loss of agricultural land(project-related) 2.Visual and Aesthetics a.Visual disruption of the surrounding community(project-related} b. Contribution to cumulative disruption of the surrounding community(cumulative impact) 3.Air Quality a. Contribution to cumulative regional air pollutant emissions(cumulative impact) 58
