f ATTACHMENT C <br /> STATEMENT OF OVERRIDING CONSIDERATIONS FOR THE AUSTIN ROAD <br /> LANDFILL EXPANSION <br /> A. SIGNIFICANT UNAVOIDABLE IMPACTS OF THE PROJECT: <br /> The Planning Commission of San Joaquin County has reviewed the Supplemental Environmental <br /> Impact Report(EIR)prepared for the permit approvals for the Austin Road Landfill Expansion, <br /> as proposed by the City of Stockton(the Project). The EIR has been prepared in accordance with <br /> the California Environmental Quality Act(CEQA), and consists of the Draft Supplemental EIR <br /> dated 12 November 1999, including the appendices thereto,and the Final Supplemental ETR <br /> dated January 31, 2000, containing the comments and responses to comments(the ETR). The <br /> Planning Commission has made findings related to the EIR prepared for the Project pursuant to <br /> Section 21081 of CEQA(hereinafter the CEQA Findings). <br /> Section 15093 of the CEQA Guidelines requires the lead agency to balance the benefits of a <br /> proposed project against its unavoidable significant,adverse impacts and to determine whether <br /> the project-related significant impacts can be acceptably overridden by the project benefits when <br /> the two are compared and balanced. As outlined in the separate CEQA Findings, Section IV.C. <br /> prepared for the Austin Road Landfill Expansion,the project as proposed would produce <br /> unavoidable,significant adverse impacts in four environmental categories:Land Use, Plans and <br /> Policies(project-related);Visual and Aesthetics(both project-related and cumulative);Air <br /> Quality(cumulative only); and Geology, Soils,and Seismicity(project-related). <br /> The Planning Commission adopts this Statement of Overriding Considerations with respect to the <br /> significant,unavoidable impacts identified in the EIR, especially identified as: <br /> 1.Land Use,Plans and Policies <br /> a.Loss of agricultural land(project-related) <br /> 2.Visual and Aesthetics <br /> a.Visual disruption of the surrounding community(project-related} <br /> b. Contribution to cumulative disruption of the surrounding community(cumulative <br /> impact) <br /> 3.Air Quality <br /> a. Contribution to cumulative regional air pollutant emissions(cumulative impact) <br /> 58 <br />
