i <br /> 1. Excavation operations shall not be carried on during the <br /> hours from 9: 00 p.m. through -5: 00 a.m. except during <br /> k periods of declared national, state, or local emergency. <br /> These hours are to be based on either Pacific Standard <br /> Time or Pacific Daylight Saving Time, whichever is <br /> legally in effect (Section 9-2244 [f] ) . <br /> M. Any night lighting established on the property must be <br /> arranged and controlled to not illuminate public rights-- <br /> of-way or adjacent properties (Section 9-2244 [g] ) . <br /> n. Operations shall be in accordance with any instructions <br /> from the Agricultural Commissioner to control the spread <br /> of noxious weeds (Section 9-2244 [j ] ) . <br /> o. The excavation must not cause health or sanitary hazards <br /> and shall not create conditions which will cause the <br /> breeding or increase of mosquitos, rodents, or other <br /> pests (Section 9-2244 [k] ) . <br /> S <br /> p. Reclamation of the site for grazing shall be in <br /> conformance with an approved reclamation plan. <br /> q. Protective vegetative planting is required for the entire <br /> site. The type and method of seeding shall be to the <br /> specifications of the Soil Conservation Service (Section <br /> 9-2244 [d] ) . <br /> r. The applicant shall pay a fee to the County of San <br /> Joaquin to cover the cost of an annual inspection of the <br /> r excavation to assure compliance with the provisions of <br /> G the permit. If necessary, ' professional outside <br /> consultation shall be employed. The cost of such <br /> consultation shall be added to the inspection fee <br /> (Section 9-2244 [s] ) . <br /> S. The excavation shall comply with the Mitigation <br /> Monitoring Program which was prepared as part of the <br /> Initial Study and is included in the staff report <br /> (California Public Resources Code, Section 21081. 6) . <br /> t. The applicant shall retain a registered Civil Engineer or <br /> licensed Land Surveyor to submit a Certification of <br /> Compliance for approval by the Development Services <br /> Division. The Certification shall include certified <br /> findings by the engineer or surveyor that the final <br /> elevations and slopes comply with those approved under <br /> this permit and that the excavated site has been <br /> rehabilitated in compliance with the revegetation plan <br /> approved by the Soil Conservation Service. The applicant <br /> shall maintain a valid surety bond at all times prior to <br /> Conditions of Approval - 3 - (Qx-91-4) <br /> i <br /> i <br />
