Phase 1 Environmental Site Assessment <br /> Neighborhood G <br /> Page 6 <br /> 2.3 CURRENT USES OF THE PROPERTY <br /> The Site is used for agricultural purposes and is currently planted with corn and alfalfa, with some fallow <br /> fields. <br /> 2.4 DESCRIPTIONS OF STRUCTURES,ROADS,OTHER IMPROVEMENTS ON SITE <br /> A single-lane dirt road traverses the Site from north to south through the center of the Site properties. An <br /> east-west trending single-lane dirt road crosses the western third of the Site from the western Site <br /> boundary to the north-south road. A third single-lane dirt road runs east from the northern portion of the <br /> north-south trending road and then turns south.An unlined irrigation canal runs from the northwest corner <br /> of the Site to Mountain House Creek (creek), flowing in a southeasterly direction.Mountain House Creek <br /> runs along the southeastern boundary of the Site flowing in a northeasterly direction. A small cattle <br /> stockyard is next to the creek. Concrete standpipes, indicating underground conduits and pipelines, can be <br /> located along the center road. Underground drainage pipes are indicated throughout the area in the <br /> Preliminary Title Report. <br /> 2.5 CURRENT USES OF THE ADJOINING PROPERTIES <br /> Adjoining properties are used for agricultural purposes. Crops consist of alfalfa and corn. An older <br /> farmhouse, outbuilding, and well lie on the adjoining property to the east along the southeastern bank of <br /> Mountain House Creek. Additionally, this property has four aboveground storage tanks (ASTs), farm <br /> equipment, two electrical transformers, several piles of used tires, and a construction office trailer with a <br /> cyclone fence. Another cluster of farm residences are located further to the east along Mountain House <br /> Parkway. To the southeast lie fallow fields and a construction site for a commercial and residential <br /> development. A large cornfield with a farm residence and outbuilding are located on the adjoining <br /> 1 property to the south. On the adjoining property lying southwest of the Alameda-San Joaquin County <br /> Line are located a farmhouse with a well, a farmyard with two ASTs and parked farm equipment, and a <br /> canal. The western and northwestern adjoining properties are currently agricultural fields. Fallow <br /> agricultural fields constitute the adjoining property to the north. Union Pacific Railroad tracks and Byron <br /> Road parallel each other further to the north. <br /> 3.0 USER PROVIDED INFORMATION <br /> 31 TITLE RECORDS <br /> The Preliminary Title Report dated September 25, 2000, from Commonwealth Land Title Company, was <br /> reviewed as part of the Phase I ESA. The Preliminary Title Report indicates that there are five easements <br /> affecting the four parcels. Arnaudo Brothers Partnership owns all rights to oil, gas, minerals, and other <br /> hydrocarbon substances lying below a surface depth of 500 feet without the right of surface entry and an <br /> easement for access right. Pacific Gas and Electric Company (PG&E) maintains an easement for the <br /> right-of-way of an electric transmission line. An easement for the rights of the public for ingress and <br /> egress, as well as navigation and fishing exist. The Byron-Bethany Irrigation District has the right for <br /> ingress and egress, pole lines, and to construct, operate, and maintain pipelines and/or drainage conduits, <br /> as well as conveying and diverting drainage of water,and drainage rights. The County of San Joaquin has <br /> rights to ditches, pipes and drainage purposes. Additionally, there are several "facts" listed within the <br /> Preliminary Title Reports. One fact states that a Pacific Bell underground cable runs along the east-west <br /> road without an easement. Condor has no knowledge of whether or not these easements and facts (and <br /> any others contained within the Preliminary Title Report) affect the Site property.
