HOLD HARMLESS ,PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify,.and hold harmless the local agency or its agents, officers, and <br /> employees from any claim, action, or proceeding against the local agency or its agents, officers, or <br /> employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, <br /> appeal board, or legislative body concerning a subdivision, which actions is brought within the time <br /> provided for in Section 66499.37 of the Government Code. <br /> 3. DEPARTMENT OF PUBLIC WORKS(Staff Contact: Trueman Phillips, 468-3000) <br /> a. An encroachment permit from Caltrans shall be required for any work within the right-of-way of State <br /> Route 88. (Development Title Sections 9-1145.4 and 9-1145.5) <br /> b. All improvements shall be in conformance with the latest edition of the Improvement Standards and <br /> Specifications of the County of San Joaquin. All improvement plans and specifications shall include <br /> a grading plan for each individual lot, if applicable. These improvement plans and specifications are <br /> subject to plan check and field inspection fees and must be approved by the Department of Public <br /> Works prior to approval of the.Final Map.. (Development Title Section 9-1100 and Resolution R-92- <br /> 814) <br /> c. A grading plan shall be submitted and approved prior to approval of the Final Map. The grading plan <br /> shall contain the information listed in the 2001 C.B.C. Chapter 18, Appendix, Chapter 33, Section <br /> 3309,with complete drainage details and elevations of adjacent parcels. Retaining wall details shall <br /> be submitted where applicable. The 50-foot-wide private road easement, cul-de-sac, and a 10-foot-wide strip along both sides of the <br /> private road and cul-de-sac shall be designated as a public utility easement on the Final Map. A 10- <br /> foot-wide strip along all drainage lines leading to the drainage facility and strips over and along all <br /> drainage swales shall also be designated as public utility easements on the Final Map. <br /> f. Anderson Street,Atheam Street, and°B"Street shall be constructed in conformance with the <br /> standards for one-half of a 5b-foot-wide right-of-way rural roadway complete with an asphalt concrete <br /> dike. The public road connections to State Route 88 at Anderson Street and Athearn Street shall be <br /> brought up to current Caltrans standards in accordance with Section 405.7, "Public Road <br /> Intersections,"of the Caltrans Highway Design Manual, Fifth Edition, (Development Title Section 9- <br /> 1150.2) <br /> h. The private road shall be constructed in conformance with the standards for a 50-foot-wide right-of- <br /> way rural residential street and shall be named in accordance with County standards.
