Steve Gikas and Lori Gikas -3- 19 August 2013 <br /> Golden Gate Nut Company/California Nuggets, Inc. <br /> Evidence in the Board's files indicates that Steve Gikas and Family currently owns and operates <br /> the Golden Gate Nut Company/California Nuggets, Inc. in San Joaquin County. The facility <br /> operations pose a threat to the quality of waters of the state, and Board staff does not have <br /> sufficient information to write Waste Discharge Requirements that will ensure compliance with <br /> applicable policies and regulations. The burden, including costs of the reports, bears a reasonable <br /> relationship to the need for the reports because this information was previously required by the <br /> Cleanup and Abatement Order and in addition, is necessary in order to prepare Waste Discharge <br /> Requirements. <br /> Pursuant to Water Code section 13267, the Board hereby orders Golden Gate Nut <br /> Company/California Nuggets, Inc. to submit a technical report that contains the following <br /> information by 15 September 2013. The submittal shall be prepared by a registered professional <br /> engineer or geologist. <br /> 1. A detailed schedule for full implementation of the proposed improvements listed above. <br /> 2. Definition of the volume of the existing lined wastewater pond with two feet of freeboard (based <br /> on the measured geometry, including depth, of the pond); the date of liner installation for the <br /> pond; and documentation of construction quality assurance measures and liner leak testing <br /> performed prior to liner acceptance (if any exists). <br /> 3. A water balance based on current wastewater character and flows that demonstrates: <br /> a. The additional LAA acreage required to prevent overloading with water, nitrogen, BOD, and <br /> salts. <br /> b. The volume of additional wastewater storage required. <br /> The water balance must demonstrate adequate wastewater storage and disposal capacity for <br /> both the average rainfall year and the 100-year return period total annual precipitation, <br /> including consideration of at least the following: <br /> • A minimum of two feet of freeboard in each pond at all times (unless a registered civil <br /> engineer determines that a lower freeboard level will not cause overtopping or berm <br /> failure). <br /> Historical local evapotranspiration, pan evaporation, and lake evaporation data (monthly <br /> average values). <br /> • Local precipitation data with the 100-year return period annual total distributed monthly in <br /> accordance with mean monthly precipitation patterns. <br /> • Proposed land application area hydraulic loading rates distributed monthly in accordance <br /> with expected seasonal variations based on crop evapotranspiration rates. <br /> 4. A conceptual design and detailed schedule for completion of new LAAs and additional lined <br /> storage pond. The conceptual design shall include the specific location and dimensions of <br /> the proposed improvements, the surface area of the new LAA(s), the volume required for <br /> the new lined pond, and a description of the proposed liner materials. <br /> 5. A description of the specific means of storm water management at the facility and how <br /> those practices will be changed to accommodate loss of the current storm water detention <br /> basin. <br />
