a. Phasing of areas from agricultural to urban use—locations and time frames; <br /> b. Irrigation water supply and service plan approved by BBID; <br /> c. BBID encroachment permits; <br /> d. Temporary buffering that includes a 100-foot setback (or as adjusted by condition <br /> 10) between the edge of development and ongoing agricultural operations as the <br /> project builds out; <br /> e. Permanent setbacks; <br /> f. Landscape buffers; and <br /> g. Fencing, signage or other suitable measures to minimize noise, spray drift and <br /> limit the potential for trespass on agricultural lands and BBID facilities. <br /> In addition, the plan shall address the following: <br /> h. Chemical applications; and <br /> i. Dust management. <br /> Note: An exception to the requirements specified in (a), (d), (e), (f), (h), and (i) may <br /> be granted when the owner of such agricultural land has indicated in writing that the <br /> land will no longer be used for agricultural production. <br /> Timing: Condition shall be met prior to approval of the Final Map. [MP policies 3.2.4 g), h) <br /> and i) and Specific Plan III Implementation Measure 3.2.4.3. d and e] <br /> 16. Right To Farm Recordation And Notification: The deed of each parcel shall include the <br /> following recording notification, as specified by San Joaquin County Ordinance 4217 which <br /> added Section 6-9004 et. seq. to Chapter 1 of Division 9 of the San Joaquin County <br /> Ordinance Code regarding the Right to Farm Notice: "All persons purchasing lots within the <br /> boundaries of this approved map should be prepared to accept the inconveniences or <br /> discomforts associated with agricultural operations or activities,such as noise, odors, insects, <br /> dust or fumes. San Joaquin County has determined that such inconveniencies or discomforts <br /> shall not be considered to be a nuisance." [Implementation Measure 3.2.4.3.fJ <br /> Timing: Prior to approval of Final Map(s). <br /> NOISE <br /> 17. Soundwalls: The developer shall construct sound walls pursuant to the"Preliminary Wall <br /> Plan""for the Tentative Map, consistent with Specific Plan III Figure 4-26 (Wall and Fence <br /> Location Plan), Figure 4-27 (Community Wall, Agricultural Fence, View Fence, Security <br /> Fence, and Chain Link Fence), and Figure 11-1 (Soundwall Locations), and with the MHCSD <br /> Design Manual. The soundwall along De Anza Boulevard shall be 7 feet in height. Where <br /> soundwalls would exceed this height standard, berms shall be used to reduce the overall <br /> soundwall height to 7 feet as measured from the top of the berm to the top of the wall. Where <br /> any openings in Soundwalls are proposed for pedestrian access, "return"walls shall be <br /> provided at the openings. Entry walls into the subdivision may be increased one foot or <br /> more, subject to CDD and MHCSD approval. The developer shall prepare and submit to <br /> CDD a detailed noise study, prepared by a noise consultant, that evaluates noise conditions <br /> and soundwall requirements and that takes into account the final design and grading of the <br /> subdivision. The proposed soundwall (or portion thereof) along De Anza Boulevard may be <br /> constructed to a height that is less than the 7-foot required height, subject to the inclusion of <br /> this deviation in the noise study and its approval by CDD and MHCHD. [Implementation <br /> Measure 4.2.8.3.d] <br /> Timing: Soundwall design submitted with Improvement Plans; detailed noise study submitted <br /> prior to approval of the applicable final map; soundwall constructed as part of the applicable <br /> final map prior to occupancy of the first residence along De Anza Boulevard. <br /> 4 <br />
