Under this exception, the completion of the full street <br /> improvements will be the responsibility of future adjacent developments. For this <br /> exception, the developer shall be required to construct the full street <br /> improvements to the street centerline plus the remainder of the median <br /> improvements (if part of the street design) plus one additional travel lane on the <br /> opposite side plus a paved shoulder. Reliance on a future adjacent development <br /> to complete the street improvements does not relieve the initial developer from <br /> designing and constructing drainage facilities to serve the exempted <br /> improvement area. <br /> q. Construct Ultimate improvements for Teixeira Avenue from DeAnza Blvd to <br /> Prosperity Street. <br /> r. Construct full improvements west of centerline and one lane east on DeAnza <br /> Blvd, from Teixeira Avenue to the northerly edge of the park strip. <br /> s. Prosperity Street: <br /> i. For the area west of the tower fine easement in Tract 3670, construct <br /> improvements sufficient for 2-way traffic on Prosperity Street from the northerly <br /> boundary of D2 to Teixeira Avenue. <br /> ii. For Tract 3671, construct improvements sufficient for 2-way traffic on <br /> Prosperity Street from Teixeira Avenue to Grant Line Road. <br /> iii.For Tract 3671, construct the intersection of Prosperity Street and Grant Line <br /> Road and install a signal when warranted as determined by MHCSD. <br /> Timing:Construction shall begin prior to issuance of the first applicable building <br /> permit. <br /> 38. Deferring Improvements: It is possible that the MHCSD may allow the deferring of <br /> street improvements (including utilities). If the developer wishes to pursue this option, <br /> then a formal written request shall be submitted to the MHCSD after the Tentative Map <br /> has been approved but before the approval of the Final Map. The request should define <br /> those street improvements that the developer wishes to defer. If the MHCSD should <br /> approve the deferment, it will be conditioned in the developer agreeing to construct the <br /> deferred improvements within a specified future time period and that a security, such as a <br /> bond, be provided the MHCSD guaranteeing the developer's performance. <br /> 39. Standard Policy For Phased Improvements: As a condition for allowing the <br /> subdivision, the MHCSD requires the subdivider of each phase of the Tentative Map to <br /> improve all streets as shown on the Tentative Map as well as other public rights-of-way <br /> that are required to serve the phased development and as stated in the EIR traffic study. <br /> The street improvements shall include all street pavement, curbs, gutters, sidewalks, <br /> landscaping, lighting, signs, underground utilities, as applicable, consistent with the <br /> Tentative Map and MHCSD Development Standards. Each Final Map shall have at least <br /> two access points from either an arterial or collector street. <br /> 40. Allowed Exception to the Standard_Policy for Phased Improvements: <br /> a. The MHCSD General Manager may allow part of the street improvements noted <br /> in the condition above to be installed by the developer if the particular street falls <br /> along the border of the Tentative Map or separates the proposed phase with a <br /> future phase.
