52. Other Water System Facilities: Construction of water distribution and storage system <br /> sufficient to serve the development being served shall be done in accordance with the <br /> Water MasterPlan and analysis by West Yost Associates dated 14 December 2006, as <br /> directed by the MHCSD prior to issuance of the first building permit. <br /> 53. Traffic—Calming Circles: The applicant shall implement traffic circles intersections as <br /> proposed on the Tentative Map and the Pedestrian, Bicycle, Transit, Open Space and <br /> Recreation and Trails Plan submitted with the Tentative Map applications for the Tracts. <br /> All proposed traffic circles shall conform to MHCSD traffic circle standards. <br /> 54. The applicant shall comply with the requirements of the Transportation Demand € <br /> Management and Transit Plan (Hoyt, 1997) as administered by the MHCSD. Timing: <br /> ongoing. <br /> 55. Construction Emissions: The applicant shall implement the following: Regulation Vill <br /> Control Measures of the SJVAPCD and applicable measures of the SJVAPCD Guide for <br /> Assessing and Mitigating Air Quality Impacts. Timing: Note on improvement plans <br /> approved by the MHCSD for Tracts. <br /> t <br /> 56. Construction-Related Erosion: The applicant and/or contractor shall comply with <br /> applicable NPDES General Construction Activities Storm Water Permit requirements <br /> established by the Clean Water Act.Pursuant to the NPDES Storm Water Program, an <br /> application for coverage under the statewide General Construction Activities Storm Water <br /> Permit (General Permit)shall be obtained for project development prior to the issuance of <br /> grading permits. The applicant and/or contractor shall obtain coverage under the General a <br /> Permit by filing a Notice of Intent with the State Water Resource Control Board's <br /> (SWRCB) Division of Water Quality: The filing shall describe erosion control and storm <br /> water treatment measures to be implemented during and following construction and } <br /> provide a schedule for monitoring performance. MHCSD approved BMPs shall serve to <br /> control point and non-point source pollutants in storm water and shall constitute the t <br /> project's storm water pollution prevention program (SWPPP)for construction activities. <br /> Timing: All applicable permits shall be obtained prior to the issuance of grading permits <br /> t <br /> for the relevant Tracts. <br /> 57. The applicant, in conjunction with the MHCSD and school districts, shall address traffic <br /> control and standard'traffic safety measures, such as "walk to school plans", at the I <br /> elementary and high school sites. Timing: As improvement plans are submitted for the <br /> school sites. <br /> 58. Hold Harmless Provision: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the local agencies, the MHCSD or <br /> its agents, officers, and employees from any claim, action, or proceeding against the local <br /> agency or its agents, officers, or employees to attack, set aside, void, or annul an <br /> approval of the local agency, advisory agency, appeal board, or legislative body <br /> concerning a subdivision, which action is brought within the time provided for in Section t <br /> 66499.37 of the Government Code. This Hold Harmless Provision including, but not i <br /> limited to, any action that may be taken by U.S. Fish &Wildlife and/or California Dept. of <br /> Fish & Game pursuant to FESA and CESA relative to the lower fees collected pursuant to <br /> the SJMSCP before it is officially adopted. } <br /> 59. Landscapinsa and Architecture: f <br /> a. All In-tract landscaping and utility RNV areas and all other landscape areas that <br /> were not in the original Master Plan, the MHCSD Parks, Recreation and Leisure <br /> Plan, the TIF or the CFF (January, 2003) as determined by MHCSD, will require <br /> a funding mechanism such as HOA or Landscape and Lighting Maintenance <br /> District as determined by MHCSD General Manager.
