If Human burials are found to be of Native American origin, steps shall be taken pursuant to <br /> Section 15064.5(e)of the Guidelines for California Environmental Quality Act. <br /> Timing: At the time of the find until permission to proceed is granted by CDD. <br /> il. MOUNTAIN HOUSE COMMUNITY SERVICES (Staff Contact: Morgan <br /> Groover 209-831-5666) <br /> GENERAL <br /> 1. All subdivision improvements shall be in conformance with Community Approvals, including, <br /> but not limited to, subdivision improvement plans and specifications, the latest Improvement <br /> Standards and Specifications of the Mountain House Community Services District(MHCSD), <br /> the Design Manual, Master Plan, Specific Plan II, master utility plans, and other standards <br /> and plans adopted by the MHCSD. These improvement plans and specifications must be <br /> approved by the MHCSD prior to approval of each phased Final Map or before work is <br /> commenced. <br /> 2. The developer shall comply with all requirements of SP II, SP II Initial Study, including, but <br /> not limited to, County, State and Federal requirements relative to air quality, storm water <br /> discharge, waste disposal and hazardous waste. Any reference to Standards used in these <br /> Conditions of Approval shall be interpreted to be the MHCSD Standards in effect at the time <br /> of the improvement plan submittal and approval to the extent that such standards do not <br /> conflict with the MARA. <br /> 3. MHCSD Master Restrictions shall be recorded on the property concurrently with the <br /> recordation of any final map. <br /> 4. All required onsite and offsite easements and dedications shall be offered to the MHCSD <br /> through offers of dedication to the MHCSD or shall be recorded on the Final Map. Dedication <br /> of public rights-of-way shall be in conformance with the adopted Public Land Equity Program <br /> (PLEP). Any easements to be abandoned that belong to an irrigation district shall not be <br /> abandoned without prior approval of that district. <br /> 5. All costs incurred by the MHCSD for any applicant development project shall be paid by the <br /> applicant in accordance with the MHCSD Development Project Fees for Services Agreement, <br /> dated October 9, 2009, between MHCSD and Shea Mountain House LLC. <br /> 6. Except where provided otherwise in a Project Acquisition Agreement or Project <br /> Reimbursement Agreement, prior to the recording of any Final Map, all infrastructure facilities <br /> outside the boundary of the Tentative Map (water, sewer, storm drainage, electric power, <br /> natural gas, telephone, communications, etc.) necessary to serve Neighborhood "K"or"L" <br /> shall be in place and fully operational. Any deferral will require the developer to provide the <br /> MHCSD a bond insuring the eventual construction of the facility. <br /> 7. All conditions on the"Will Serve Letter"from the MHCSD shall be met prior to approval of <br /> Final Map, unless specified otherwise in the letter. The MHCSD General Manager may defer <br /> the installation of a facility if bonding is provided and it can be demonstrated to the <br /> satisfaction of the MHCSD Public Works Director that it is not needed at that time. <br /> B. All reference to approvals herein by the MHCSD shall be interpreted as approval by the <br /> General Manager or his or her designee, except for those approvals specifically delegated by <br /> law to the Board of Directors. <br /> Conditions of Approval -10- <br />
