Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Initial Study for Neighborhoods K and L at Mountain House dated <br /> September, 2011, (SCH #2011092041) based on the following findings: <br /> a. The 1994 Mountain House Master Plan Final Environmental Impact Report <br /> ("MEIR")was certified more than five years prior to filing the application for the <br /> project; <br /> b. After completing the Initial Study, it has been determined that a Mitigated <br /> Negative Declaration would address substantial changes that have occurred <br /> with respect to the circumstances under which the MEIR was certified and <br /> would address new information; and <br /> c. The cumulative impacts, growth-inducing impacts, and irreversible significant <br /> effects identified in the MEIR are adequately addressed for the project. <br /> 2. Approve the Tentative Maps for Neighborhoods K and L(i.e., Major Subdivision <br /> Application PA-1000266 and Major Subdivision Application PA-1000267)with the <br /> Findings and Conditions of Approval contained in this staff report. <br /> 3. Adopt the CEQA findings contained in Appendix C of this staff report, on behalf of <br /> the County of San Joaquin as the lead agency for the Mountain House Master Plan <br /> and for the approval of the Tentative Maps for Neighborhoods K and L., affirming <br /> that,with the mitigation measures included in the Tentative Maps for K and L or <br /> included as Conditions of Approval for the Tentative Maps for Neighborhoods K and <br /> L,the MEIR continues to remain valid and that the Tentative Maps for Neighborhoods <br /> K and L are within the scope of the MEIR. <br /> Findings <br /> 1. The proposed subdivision is consistent with the General Plan, the Master Plan, any <br /> applicable Specific Plan, any applicable Special Purpose Plan, the Public Financing Plan, <br /> and any other adopted plan adopted by the County. <br /> • This finding can be made since the analysis conducted by the Community <br /> Development Department (CDD) in Appendix A of this staff report has shown that <br /> the proposed subdivision is consistent with all applicable adopted plans. <br /> 2. The design or improvement of the proposed subdivision is consistent with the General Plan, <br /> the Master Plan, any applicable Specific Plan and any applicable Special Purpose Plan. <br /> • This finding can be made since the analysis conducted by CDD has found that <br /> the design or improvements of the proposed subdivisions, as shown on the <br /> Tentative Maps and as described in the project application, meets the <br /> requirements of the General Plan, Master Plan,and Specific Plan II. The design of <br /> the proposed subdivisions provides additional housing opportunities for future <br /> residents. As conditioned, it meets the residential density requirements of <br /> 34 <br />
