UP-93-4 OF TRACY MATERIALS RECOVERY AND TRANSFER, INC. (C/O DAN MAGLIONICO) ----------------------------------------------------------------- This Use Permit Application is to establish a solid waste transfer and resource recovery facility at a site located on the west side of Mac Arthur Drive, approximately one mile south of the intersection of Mac Arthur Drive and Linne Road, south of Tracy. An Environmental Impact Report has been prepared for this project. Staff is in the final stages of preparing the Final EIR and responding to comments on the Draft EIR. Because the Final EIR has not yet been completed, the following Conditions of Approval are still in a draft form, and may be modified or added to based on the Final EIR. Should additional conditions be developed, or changes made to the following conditions, the applicants will be notified immediately. I The Development Services Division has reviewed this proposed Use Permit, and will be recommending that the Final EIR be certified as adequate, and that the Use Permit be approved subject to the following Conditions of Approval and Ordinance requirements: Unless otherwise specified, all Conditions of Approval must be fulfilled prior to the establishment of the new use and the issuance of any building permits. This approval will expire 18 months from the date of approval unless (1) all Conditions of Approval have been complied with, (2) all necessary building permits have been secured and remain in force, and (3) all necessary permits from other agencies have been secured and remain in force.
