Community Development Derzrtment <br /> PA-0400492 <br /> We appreciate any assistance the County can give school districts towards mitigation of the impact of <br /> new development, to the extent permitted by law. It is conceivable that the current law regarding <br /> school impact mitigation may change in the future to once again authorize counties to have greater <br /> participation relating to school facilities, and we believe it is essential that the County retain language in <br /> its general plan that "to the extent permitted by law" the County will require new projects to mitigate <br /> impacts on school facilities. By retaining such language, the county will be in a position to assist with <br /> requiring mitigation from development projects for school facilities without first needing to complete a <br /> lengthy process to amend the general plan. <br /> Further, in October of 2004 when this project was originally considered, the Community Planning <br /> Department had several concerns regarding drainage and sewer systems. Ultimately, the SJ County <br /> Board of Supervisors overturned the Planning Commissions approval of this project. At this writing, <br /> we have seen no documentation of improvements to this project that would change or position on this <br /> issue. Clearly, the decline in the quality of life in the greater Linden area would result with the <br /> approval of this project. <br /> Again, we thank you for the opportunity provided to comment on the proposed major subdivision. <br /> Please do not hesitate to call if you have any questions regarding these comments. <br /> Si*std.D. <br /> RoSu <br /> Cc: Monte K.
