Jan 09 02 04: 01p San Joaquin Counts 4683127 p- 2
- - --r VJ On
o+nrvP
MOSSDALE ASSOCIATES,LTD.
874 E.Woodward Ave-
Manteca,CA 95337-9261.
(209)249-2516 `4At ,-,
Jeff Fischer
San Joaquin County Development Services Division
1810 E.Hazelton Ave.
Stockton,CA 95201
January 7,2002
Re: Application No. SA-Ul-91
Dear Mr. Fischer,
am writing to respond to the above referenced application to remodel an"existing"nonconforming
mobile home park. The operation of this property in the past has resulted in the continual overflow of
untreated and/or partially treated wastewater on to our property at 96 W.Mossdale Road(see attached
letter). This, and other violations of law, resulted in the closure of this mobile home park. As the owner
socks to reopen the mobile home park,I have the following concerns that should be addressed by the
county.
1. 'Che grading plan for the site does not show a storm water retention pond Where will storm water
flows from the site, and the portion of Mossdale Road that drains onto the site,go?It is my
understanding that all storm water flows must be contained on site. The site may not continue to
use Mossdale Associates property to dispose of its storm water or wastewater.
2. The grading plan for the site does not show proposed changes in grade which will prevent
stormwater and wastewater from flowing from the site on to Mossdale Associates property. The
ten-feet wide setback area should be higher than the interior grade to prevent these flows from
occurring.
3. 1 am concerned about the potential inability of the proposed percolation ponds to adequately
dispose of the wastewater during the winter. Would the disposal area be large enough during a
period of heavy rains as we have had recently,or high water in the river?
4. 1 am concerned about the potential for nitrate and other contamination due to inadequate operation
of the wastewater treatment plant. Has the applicant performed the necessary tests, such as
percolation tests,or a nitrate loading study? What agency will have operational oversight of the
wastewater treatment plant?
5. The grading plan does not show the required elevation increase necessary to keep the mobile
homes from flooding in the future. All of the structures and mobile homes built by Brown Sand,
Inc. on the Mossdale Associates property have been required to be constructed on elevated pads
because the property is not protected from the 100-year flood. In fact,as recently as 1997 the
Mossdale Associates property and the proposed mobile home park were inundated by flood
waters.
6. The site is a proposed residential use next to Interstate 5. Based on noise studies performed in time
past by Brown Sand for the quarry,it is questionable if the site,as shown, can comply with the
county's noise ordinance if it is applied to the project.
Thank you for the opportunity to comment on this application. I request that the notice of the staff
determination of this project be sent to the above address.
Sincerely,
Mik- C Brpwn
Mossdale Associates,Ltd.
