(4) There arises an occurrence or circumstance which, in the opinion of the County or State, jeopardizes the site reclamation; or (5) The State makes one or more of the findings specified in Section 2774.4(a) of the State Public Resources Code. (6) In any instance that the County or State makes the demand for partial or full tender of the financial guarantee of performance, the County and/or state may use all or any portion of the financial guarantee to reclaim the site and to recover its administrative costs associated therewith. ENFORCEMENT: Except as otherwise provided in State Mining Regulations, the County shall have authority to enforce provisions of the Surface Mining and Reclamation Act. The County may exercise all enforcement regulations available under the County Development Title and the State Public Resources Code. Such enforcement measures include charging the applicant the costs of administering an enforcement action. The basis for charging fees for an enforcement action shall be a time and materials compensation. (Development Title Section 9-1415.3[t]) t. No excavations are permitted into the ground water table without specific approval from the Regional Water Quality Control Board, Central Valley Region (California Water Code, Chapter 4, Article 3, Section 13240) b. The materials from an excavation shall not be deposited into any watercourse or in any way contribute to the pollution thereof(California Water Code, Section 13376) c. An approved potable water supply must be provided for all employees (Development Title Section 9-1100.1) d. Approved sanitary facilities must be provided for all employees (Development Title Section 9- 1100.1) 3. SAN JOAQUIN COUNCIL OF GOVERNMENTS (Staff Contact: Erin Sickler, 468-3913) a. This project is subject to the San Joaquin County Multi-Species Habitat Conservation and Open Space Plan (SJMSCP). Please contact SJMSCP staff regarding completing the following steps to satisfy SJMSCP requirements: (1) Schedule a SJMSCP Biologist to perform a pre-construction survey prior to any ground disturbance. (2) Sign and return Incidental Take Minimization Measures to SJMSCP staff(given to project applicant after pre-construction survey is completed). (3) Pay the appropriate fee based on SJMSCP findings.
