24. Water Quality Basins Mosquito Abatement: Plans for the implementation and <br /> maintenance of the water quality basins and any other storm drainage facilities involving <br /> open bodies of water shall be reviewed and approved by the MHCSD and if required by the <br /> MHCSD, reviewed by the mosquito Abatement District. Condition shall be met before <br /> approval of first Final Map. <br /> 25. Utilities: <br /> A. The Developers and contractors shall comply with Ordinance No.4162 "Street Opening <br /> and Pavement Restoration Regulations". <br /> B. When any portion of an arterial street is to be included in a development's construction <br /> plans, then all of the buried utilities that are ultimately planned to be within the <br /> improvement area shall be installed as part of the street improvement project regardless <br /> if any of the utilities are required for any phase of the development associated with the <br /> street construction. Conduits or sleeves may be installed in lieu of the buried utility if <br /> approved by the MHCSD. <br /> C. Any phased development shall install all "in-tract" utilities required to serve the <br /> development. In addition, if any future adjacent or nearby phases of the development, <br /> or adjacent Neighborhoods, will depend on obtaining service from such utilities, then the <br /> utility lines shall be sized to serve these future developments. Any utility lines that are <br /> intended to be used by an adjacent development or Neighborhood shall be installed up <br /> to the phase or Tentative Map boundary line to make it available for future extension.To <br /> recoup all or a portion of any over sizing costs, the developer may request the MHCSD <br /> to process a reimbursement agreement pursuant to the MARA. <br /> D. When public utilities are to be located outside public rights-of-way but within the <br /> Tentative Map boundary, the developer shall provide public utility easements for these <br /> utilities. The easements shall be shown on all Final Maps and parcel maps. <br /> E. Prior to the submittal of improvement plans for the development, the developer shall <br /> submit to the MHCSD composite schematic plans for in tract storm drains, sanitary <br /> sewers, and water distribution facilities. <br /> F. Electrical transformers within residential Neighborhoods shall be in underground vaults, <br /> subject to MHCSD and Modesto Irrigation District(MID)requirements. The developer <br /> shall pay for any incremental costs relating to undergrounding transformers not paid for <br /> by MID. Transformers located in the downtown area, commercial and industrial areas <br /> may be placed above ground provided they are aesthetically designed and/or shielded <br /> by landscaping subject to MHCSD and MID requirements. <br /> 26. Wastewater Treatment Plant: <br /> A. Under the direction of the MHCSD, the applicant shall fund, design and construct a <br /> phased expansion of the wastewater treatment plant (WWTP)of sufficient capacity, no <br /> less than 1.5 mgd,to serve Tract No. 3557 prior to issuance of the first building permit. <br /> Recognizing that there may be agreements between the developers for sharing capacity <br /> and also recognizing that the MHCSD is not a party to and has no control over such <br /> agreements, bonding for construction shall be provided prior to approval of the first final <br /> map and beginning of construction shall be at the discretion of the General Manager. <br /> Issuance of building permits shall cease if construction does not begin when directed by <br /> the General Manager. <br /> B. The developer shall extend existing pipelines to the project site as shown on the Master <br /> Sanitary Sewer Plan. Interim treated wastewater land disposal capacity and piping <br /> system to serve the proposed project shall be provided by the developer until such time <br /> 23 <br />
